Well I guess you R-calf beggars are getting your way! Twisted Evil May god bless you with 7 years of severe drought! Wont be any hay crossing the border into your country! When the 7 years is over may you break a several mirrors!


U.S. Border to Remain Closed to Canadian Cattle for Months

OMAHA (DTN) -- The American border will probably stay closed to Canadian cattle for at least three months and more likely 8 to 11 months, says the latest commentary from ag writer Kevin Hursh.

That assessment comes from Ted Haney of the Canada Beef Export Federation. Haney doesn't claim to be an expert on the American legal process, but he attended briefings that included legal analysis from Canadian lawyers, says Hursh.

If Haney is correct, the border won't be opening in a matter of days or weeks. In fact, if the injunction is made permanent, the whole legal process could take more than a year.

We don't have any written agreements saying that if we test them, you will accept them.

I've never seen where you tried to get an agreement. Wink

Aside from that, wouldn't that be an arrow in your quiver when you make your arguements as to the safety of your beef?

With the court calender being plugged as bad as it is, that may be a very optimistic time period.... I was sued in the same Federal District Court for a wrongful death suit in 1995 over an incident that occurred in March of 1995- Federal Judge heard arguments and made his initial ruling in 1997 ( which removed me from the suit) - before it could go to trial it was appealed to the 9th Circuit Court that heard it in 1998 and sent it back to the District Court to again set for trial--- it was finally settled in 2001..... Speed is something the court system does not know......

Well then OT I guess they better just open the border! I am hearing tonite that GWB is going to put this matter infront of three judges and there ruling will over rule some pot bellied Judge's decision in R-calf country!

MR- Not even GWB can change the constitutional function of the Judiciary--The 3 judge panel that you and GW speak of is part of the 9th Circuit Appeals Court-- Cases, because of the heavy caseload, are usually never heard by the full court-- 3 of the apellatate judges will first hear the case- then if they feel its necessary they may schedule it to be heard by the entire court (20+ members) or if either side does not agree with the 3 judge panel they can appeal it to be heard by the entire court... but none of that has been set into motion yet as USDA hasn't filed the appeal yet---Personally I don't think the 9th Circuit will overturn Cebull before a trial-I'm wondering if USDA isn't thinking the same...

Well OT that is where we disagree. This is a very important matter and will be fast tracked. Hows things down your way? Its nice here this morning but supposed to turn ugly tonite as we are in for some periods of rain. With all the snow it sure will be a sloppy mess, but we will sure take the moisture!

Gee, Shelly, I thought it was just southern Alberta that got to "enjoy" 100+ km winds! Laughing Heavy clouds are are rolling in from the west, so it looks like moisture is on the way.

We could use a nice rain, but we aren't really hurting for moisture yet. As for the wind, my mom taught me to share...... Laughing There is rain and snow in the forecast, but I can't say I am looking forward to the return of winter. Calving heifers is much nicer with +12 temperatures (and no wind!).
