On Thursday, the Senate Judiciary Committee approved a measure which would make three DUI convictions an aggravated felony, and a deportable offense. Sen. Charles Grassley (R-IA) introduced the legislative action as an amendment to the Violence Against Women Reauthorization Act of 2011 (S. 1925).

Sen. Grassley's original amendment called for the policy to be applied retroactively to all DUIs. Expressing the urgency for such a policy, Grassley cited the case of Sister Denise Mosier who was killed by Carlos A. Martinelly Montano, a drunk driving illegal alien in Virginia in 2010. However, Senate Judiciary Committee Chairman Patrick Leahy (D-VT) objected to the retroactive portion of the amendment , saying it "goes against the sense of overall fairness" and instead, offered his own amendment which removed the retroactive clause. The Committee then passed the measure by a vote of 11-7.




It now moves to the full Senate.

So, what does this mean?

Effectively, if the bill passes and is signed into law, the federal government will only consider an illegal alien DUI offender for deportation, after he/she has accrued three convictions.

That's three convictions recorded after the bill becomes law.
 
If a Canadian has a twenty year old DUI and hasn't had a drink since, they can't visit the US to shop for a day but an ILLEGAL can have three DUI's before they get deported. :roll:
 
Meanwhile, if a wetback gets his/her first DUI, the goverment has in their custody an illegal alien that they KNOW is illegal, already in custody, but the crime of being illegal is completely ignored and they will be set free like it doesn't exist. Just how in the hell does this make sense?
 
this absurd action by congress shows how "stupid" our elected officials have become...

in most countries.. if you commit a crime you get jailed and then once you serve the sentence you are deported..

can't these idiots just enforce the law?

Why can't we enforce these idiots? The biggest problem with the idiots is that they are doing exactly what a bunch of other idiots want them to do.

I'm past PO'ed and am now just ashamed that so many people gave their life for this country, so our generation can pi$$ it all away.

Just goes to show that if you give someone something for free, most just won't appreciate it unless they have had to work for it.

We are headed for a place worse than where we are now.
 
We have much the same within our own country- with the sovereign Indian nations- where the first DUI penalty is 3 hours in jail (til you are sober enough to walk out) and usually a $25 fine... A non-tribal riding with the drunk tribal driver gets a bigger fine for open container :shock: :roll:

Penalties rise a little after that- but under Reservation laws- there is no such thing as a real felony (unless you kill someone- which (could?) make it a Federal case)... Its traveller beware when going thru a reservation...

As far as the illegal immigrants-- I only wish some of you would watch the congressional hearings on immigrants when they go on- and see that there are few of either party R or D fighting against it.... D's all want them as potential voters-- R's want them because all their big dollar lobbyiests (including the US Chamber of Commerce) say they need them for cheap labor..

Unless you flush the whole pot in D.C.- and remove the total Lobbyiest influence-- the illegals will be here- and thru years of precedent- gaining more and more rights given to them by our Congress.....

An ex post facto law (from the Latin for "from after the action") or retroactive law is a law that retroactively changes the legal consequences (or status) of actions committed or relationships that existed prior to the enactment of the law. In reference to criminal law, it may criminalize actions that were legal when committed; or it may aggravate a crime by bringing it into a more severe category than it was in at the time it was committed; or it may change or increase the punishment prescribed for a crime, such as by adding new penalties or extending terms; or it may alter the rules of evidence in order to make conviction for a crime more likely than it would have been at the time of the action for which a defendant is prosecuted.

How about Grassleys (Republicans) law going against the Constitution... :???:

Leahy's amendment is probably all that would allow the whole law to stand up to Judicial scrutiny... The law- following the Constitution- has long said you can't put in laws or penalties after the fact.... The law has long maintained that the law at time of the first offense has to be the law followed...


In the United States, the federal government is prohibited from passing ex post facto laws by clause 3 of Article I, section 9 of the U.S. Constitution and the states are prohibited from the same by clause 1 of Article I, section 10.
 
Democrats control the Senate and they don't want to deport some of their VOTERS.
 
So...........I guess before this law introduced there were no laws concerning illegal immigrants breaking said law and being deported? :lol: :lol: :lol:
