Because the individual mandate is unconstitutional and not severable, the entire Act must be declared void. This has been a difficult decision to reach, and I am aware that it will have indeterminable implications. At a time when there is virtually unanimous agreement that health care reform is needed in this country, it is hard to invalidate and strike down a statute titled "The Patient Protection and Affordable Care Act."

The fact it is not severable is the exact reason the Republicans should not allow an amendment to take the individual mandate out as some have been suggesting. As if that one part is allowed to be remove, the rest may survive a constitutional challenge. As long as the individual mandate is in the whole bill is ruled unconstitutional.

“I note that in 2008, then-Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that, ‘If a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house,’” Judge Vinson wrote in a footnote toward the end of his 78-page ruling Monday.

“By the way, if this is constitutional, then Republicans should turn around and mandate all citizens be forced to purchase a gun and a Bible. And, there’s a lot more evidence that owning a gun and a Bible is better for society than everyone having to own health insurance.
