I will post this in blocks, one is the information, second is a Death tax sample document where all you have to do is put in your Senator's name, and sign at the bottom with your own, third is a list of all the Senators in the US, their phone numbers (in case you just want to call) or their fax numbers in case you want to send the "sample" document with your signature via fax to your Senators. As you know, NCBA has been actively supporting full and permanent repeal of the Death Tax in the Senate for months, and it appears that we will see this issue on the Senate floor this week. Senate staffers are today reporting that cloture on a motion to proceed to H.R. 8 to fully repeal the Death Tax will be filed tomorrow, and a vote on cloture on this motion to proceed to debate on full repeal is expected on Thursday, June 8.
In order for full and permanent repeal to be considered by the Senate, we must get 60 votes in favor of cloture. This is the only way to prevent extended debate (filibuster). Many reports indicate that this procedural vote may not get the necessary 60 votes, and many media outlets are now focusing on this issue in political terms rather than focusing on it as sound public policy. Nonetheless, NCBA's efforts to achieve full and permanent repeal will continue this week, and we need your support in getting the needed 60 votes to avoid a Democratic filibuster.
Between now and this Thursday, CattleWomen need to contact your Senators, especially your Democratic Senators, and urge them to VOTE YES on the CLOTURE MOTION to PROCEED to consideration of H.R. 8. Given the tight time frame we're now working on, calls and faxes to your Senators will be most effective. Attached below is a sample letter that you can fax to your Senators offices as well as a document containing the fax and phone numbers for all Members of the U.S. Senate. Also attached is an Issues Update article that provides a quick glance at the background timeline on this issue and an overview of the past, current and future rates. Dear Senator:
As a rancher and cattle producer from your state, I am writing to urge you to VOTE YES on CLOTURE on the motion to proceed, and please support full and permanent repeal of the Death Tax when this issue moves to the Senate floor later this week. We work each day to preserve and improve the ranching operations and rich agricultural heritage established for us by our forefathers; however, our hopes of passing these rural businesses down to our children are severely threatened by the Death Tax.
In an asset-rich and cash poor business like ours, the Death Tax stands staunchly as a leading factor in the break-up of family cattle operations. Agriculture is deeply rooted in American history, with nearly half of the National Cattlemen’s Beef Association’s (NCBA) 250,000 members working on enterprises which have been in their family for 50 years and 15% operating enterprises that have been in their family for over 100 years. We diligently work to sustain our operations in the hopes of passing them down to the next generation, but with the tax-appraised value of rural lands now far exceeding the true agricultural value, we are currently forced to choose between selling off the land, parts of the operation or even the entire ranch, to cover tax liabilities.
The temporary nature of the current Death Tax provisions creates a variety of problems for family businesses as we are continually forced to pour money into costly, cumbersome and time consuming estate-planning strategies. The growth and development of agricultural enterprises has been radically hindered, with 88% of cattlemen reporting that fear of the Death Tax has changed the way they invest in their own business. With permanent repeal of the Death Tax, families would be able to reinvest resources previously required for estate-planning back into their operations. This increased investment in the enterprise would improve profitability, and in turn, lead to new job opportunities and a direct enhancement of the economic well-being in rural communities across America. With 97% of American farms and ranches owned and operated by families, elimination of the Death Tax is a crucial step in sustaining the economic vitality of rural America.
The Death Tax is an unfair tax on American values and the American dream that often serves as a death warrant for family farms, ranches and small businesses. In their final hours, rather than worrying about what must be sold off in order for the family to hold on to some shred of the operation, ranchers should be rejoicing in the knowledge that the agricultural enterprise they spent their entire life maintaining can be successfully passed on to the next generation. By supporting full and permanent repeal of the Death Tax, you will put an end to this needless and unfair tax on death and assure our state’s families that dying in 2010 is not the only way to avoid the stifling burden of this tax.
When this issue moves to the Senate floor, please VOTE YES on the CLOTURE motion to proceed, and please SUPPORT Permanent Repeal of the Death Tax! I appreciate your attention to this vital issue for so many families in our state and across America.
