AG: Health reform law does not apply in Indiana

INDIANAPOLIS | A federal court ruling means Hoosier businesses cannot face penalties for not following mandates contained in the 2010 health reform law.

Attorney General Greg Zoeller told state lawmakers Wednesday that Indiana's participation in a multistate lawsuit that resulted in a ruling that the 2010 Affordable Care Act is unconstitutional prevents the government from enforcing the law in Indiana.

"We are not allowed to use the statute as an enforcement tool to require action on the part of private-sector entities," Zoeller said.

The Republican attorney general said Indiana businesses are free to follow the law on their own, but also are free to ignore it.

Federal Judge Roger Vinson ruled Jan. 31, in a lawsuit brought by 26 states, that the Affordable Care Act's requirement that all Americans buy health insurance is unconstitutional. The federal government is appealing that decision.

The federal district court ruling has not prevented Indiana lawmakers from preparing to implement the health reform law. Republican Gov. Mitch Daniels said earlier this year he will establish an Indiana health insurance exchange even though he opposes the health law.

Zoeller said the state can act on its own authority to prepare to meet the requirements of the Affordable Care Act.

But he said the district court ruling shows the case is not frivolous, as some critics have claimed. Zoeller said he expects courts will continue to find the law unconstitutional.
