Minn. court rules for Franken in Senate fight

ST. PAUL, Minn. -- The Minnesota Supreme Court on Tuesday ordered that Democrat Al Franken be certified as the winner of the state's long-running Senate race, paving the way for a resolution in the seven-month fight over the seat.

The high court rejected a legal challenge from Republican Norm Coleman, whose options for regaining the Senate seat are dwindling.

Justices said Franken is entitled to the election certificate he needs to assume office. With Franken and the usual backing of two independents, Democrats will have a big enough majority to overcome Republican filibusters.

Coleman hasn't ruled out seeking federal court intervention.

Jim Manley, a spokesman for Senate Majority Leader Harry Reid, said the earliest Franken would be seated is next week because the Senate is out of session for the July 4 holiday.

Franken, a former Saturday Night Live star making the leap from life as a left-wing author and radio talker to the Senate, planned a news conference later Tuesday and didn't immediately comment.

Coleman's campaign didn't immediately return a call for comment. Nor did Gov. Tim Pawlenty, whose signature is required on the election certificate Franken needs to be seated.

Pawlenty, a Republican, has said he would sign the certificate if ordered to do so by the court. The court's ruling stopped short of explicitly ordering the governor to sign the document, saying only that Franken was "entitled" to it.

Coleman's appeal hinged largely on whether thousands of absentee votes had been unfairly rejected by local election officials around the state.

The unanimous court wrote that "because the legislature established absentee voting as an optional method of voting, voters choosing to use that method are required to comply with the statutory provisions."


They went on to say that "because strict compliance with the statutory requirements for absentee voting is, and always has been required, there is no basis on which voters could have reasonably believed that anything less than strict compliance would suffice."

Wow..now the $hit will really hit the fan. Americans ain't seen nothing stupid yet.....Reckon Franken even knows where Washington DC is located?? I'm sure Barney will direct him to the best lobbiest who will lead him to his office complex. Oh well...this is the same state that elected a wrestler to be governor.

Be interesting now to see if Gov. Pawlenty follows the direction of the Supreme Court and signs the certification - or whether he crawls in with the RNC if they decide to try and stall longer and appeal to the SCOTUS....
This could easily be the first case heard by Justice Sotomayor when the court comes back in session if the party of NO decides to appeal....

This has nothing to do with elitist. A little more background than comedian and talk show host would help tho.....And no, we've had lots of alcoholics, womanizers and one that would have been president forever, a peanut farmer who could never say "nuclear", another president from Texas that probably had more opponents killed than he ever defeated in an election and the list goes on. And we don't even want to talk about senators and reps. There is no elitism.

I think Bush did admit to a drinking problem in his life but never heard him referred to by anyone as a playboy. lolol Oh and half the country recommended him and loved the job he did until last year. (That probalby includes you as well as you were making money hand over fish IF you had any). :wink:

Kola I think that is the heart of the problem. Nobody really knows exactly what has been counted, recounted, thrown out, overlooked or anything else. Don't think they ever went back to square one and started over. But the state does deserve representation even if it is some half wit. I guess if Sonny Bono can do it this guy can to.

One thing that can be said about the current set up: As a party they will be in the same position that republicans were in which means that they better perform or may find themselves with the same fate current republicans do.

I hope if they can not perform that we will start voting out the members of both parties until we get a responsive government --- and not one just responsive to the people who donate to them. They need to be able to run the government instead of selling it out.

For a guy who swears he's independent Oldtimer gets a lot of joy out of every stupid thing the Democrats do! Add Franken to the long list of idiots that makeup the democrats! He'll fit in perfect with Reid, Pelosi, Clinton, Kennedy, Biden, Murtha, Micheal Moore, Al Gore, Howard Dean and the rest of the radical liberals! :roll: I'd say God help us all, but the mention of God is frowned upon in today's political environment! :roll: I bet it's even harder to be a liberal when Franken is one of the club! Glad I voted how I voted! :D :p

Wouldn't bother OT a bit if the country failed...He's got nothing to lose but free grazing land and his watering hole buddies would see that he gets to keep that too so long as he dont' get caught rustlin' cattle.
