(Fox)- The 10th U.S. Circuit Court of Appeals ruled Wednesday that 14 crosses placed along Utah highways to honor fallen Utah Highway Patrol troopers violate the U.S. Constitution.

“We hold that these memorials have the impermissible effect of conveying to the reasonable observer the message that the State prefers or otherwise endorses a certain religion,” the Denver-based court said.

Based on that determination, the 10th Circuit did not rule whether the crosses also violate the Utah Constitution, which was one of the arguments made by American Atheists Inc.

The Texas-based organization and three of its Utah members sued in 2005 to have the crosses removed from state property. The plaintiffs argue that the 12-foot-high crosses are religious symbols that violate the Establishment Clause of the federal constitution by endorsing Christianity.

U.S. District Judge David Sam in Salt Lake City rejected that argument in 2007, saying the context of the crosses was secular in nature and that they were symbols of sacrifice. Wednesday’s ruling reverses Sam’s decision.

All roadside markers/crosses like that should be outlawed.

They distract drivers and are dangerous.

Not too long ago, someone was gawking at a cross along the side of the road and drove right into an on coming truck. Killed about 3 people.

Now, there are 4 crosses there..... :roll: :roll:

I'm sorry for the deaths...but that's NOT the way to make a memeory

People put up all kinds of things....crosses, mounds of plastic flowers, pieces of plywood w/ names, etc....you name it.


It's all a distraction and should be outlawed.

If you want a nice memorial...put it in a roadside park or pull off place or overlook or the like....

Why did people Not complain about things along side of the road that are not anything to do with someones death. This is not about safety that these people are worriewd about.


It is one thing and one thing only the crosses.






In the process they disrespect these patrolmen

I'd say you would be one to ' gawk' for sure...as you sure get attached to folks it seems....

What about street signs?
mile post markers?
stop signs?
Speed limit signs?

I would agree, but that wasn't the issue..

the issue was an "out of state" group claiming a non-profit that placed the crosses, was endorsed by the state.. thus the state endorsed the religion..


The case began in 2005 when Texas-based American Atheists Inc. sued the state for allowing the Utah Highway Patrol Association to incorporate the UHP logo on the 12-foot-high crosses and place some of them on public property.

Between 1998 and 2003, the nonprofit UHPA erected 14 crosses to remember troopers, two outside a UHP office and the rest along highways, most of them on public land and several on private property.

The ruling affects all 14 because each has theUHP beehive insignia on all of them

Funds to erect the crosses were raised privately, and the troopers’ families approved of the crosses, although the UHPA said it offered to display alternate religious symbols.

For someone to throw out the safety issue, they are completely ignoring the issue. Whether it be by choice, ignorance, or complete laziness it doesn't really matter

I guess Jingo2 does not believe people should take responsibility for themselves.

Why not just advocate that they make it illegal to be distracted by the crosses, if that is the issue you have with it Jingo2. Just like cell phones.

The user of the cell phone is the one responsible, not the manufacturer or the salesperson.

Same for the crosses, it is the driver that should be responsible, not the person that placed the cross there.

Jingo2, do you think a distraction like that should be built where drivers might become distracted and cause accidents?

The VA and Auxillary have for years put up crosses at every site in Montana where someone has died in a traffic accident (highway ROW- government owned property)...Been going on for years- and I know the state has told them they have to stop- and I think there was even a court order along the same lines saying the same...Some bad road areas and treacherous corners have a dozen or more crosses... I never thought anything bad about it- gave the kids starting to drive something to think about- and the little kids something to do counting cross's while on a long trip...

But I know some were not Christians- at least one in my county I know was a Muslim lady from the Phillippines ( I was with her when she died) - and some I believe were athiests... Maybe we should honor them by putting up the Muslim crescent - and the Star of David for the Jewish-- but what then should you put up for the non believers? 666 ?

Bush's usurption of the Constitution by allowing his Justice Departments hiring of only Evangelical Christians that opposed abortion has again awakened those that don't just wear the Constitution on their sleeve and support it when it benefits their own causes--- but believe it should be supported all the time...

Me too, LC. He 's saying it's against the Constitution to hire Evangelical Christians in the Justice Dept? Could fooled me.................. :roll:
