Harvard University law professor Alan Dershowitz appeared on MSNBC’s Hardball where fill-in host Michel Smerconish asked him his opinions of the arrest warrant issued and carried out for alleged Trayvon Martin murderer, George Zimmerman. Dershowitz called the affidavit justifying Zimmerman’s arrest “not only thin, it’s irresponsible.” He went on to criticize the decision to charge Zimmerman for second degree murder by special prosecutor Angela Cory as being politically motivated.

“You’ve seen the affidavit of probable cause. What do you make of it,” Smerconish asked. “It won’t suffice,” Dershowitz replied without hesitation.

“Most affidavits of probable cause are very thin. This is so thin that it won’t make it past a judge on a second degree murder charge,” Dershowitz said. “There’s simply nothing in there that would justify second degree murder.”

Dershowitz said that the elements that would constitute that crime are non-existent in the affidavit. “It’s not only thin, it’s irresponsible,” said Dershowitz.

Dershowitz went on to strongly criticize Cory’s decision to move forward with the case against Zimmerman. “I think what you have here is an elected public official who made a campaign speech last night for reelection when she gave her presentation and overcharged. This case will not – if the evidence is no stronger than what appears in the probable cause affidavit – this case will result in an acquittal.”

Smerconish identified the total lack of any mention of the supposed fight that occurred between Martin and Zimmerman prior to Martin being shot. He said he was disappointed that he did not see any mention of that conflict that led to Martin’s murder.

“But it’s worse than that,” said Dershowitz. “It’s irresponsible and unethical in not including material that favors the defendant.”

“This affidavit does not even make it to probable cause,” Dershowitz concluded. “everything in the affidavit is completely consistent with a defense of self-defense. Everything.”

This is so thin that it won’t make it past a judge

do you see a trend here?

the police felt it was questionable so they recommended charges and kicked it up to the prosecutor who dismissed it...

then a prosecutor files charges.. and now a judge will feel the heat instead of the state....

and then... the feds will take a bite.. and file civil rights violations and ,...

(somewhere in the process a community will have a riot)

then Zimmerman will get a federal case and a few years.. on some charge not connected by reality to the actual alleged crime..

how many times must we see this type of railroading of a Hispanic or other non black minority before it is stopped.. ?

the transcripts of the 911 call clearly show Zimmerman not only listened to the dispatcher but was going to meet the police officers..

how can a law enforcement official clearly disregard facts?

I guess if you repeat a lie often enough even a trained police officer will believe it?

It appears she did not want to bring charges, but did under pressure. She sure hasn't built much of a case, so far.

The defense clearly has an "out"

You also have the eye witness that said the man with the red jacket which was Zimmerman was calling out for help while he was being beaten on the ground. And when he came back out the guy that was on top doing the beating was laying on the ground dead which was Trayvon.

The only ones that claim it was Trayvon calling out for help were the ones that didn't step foot out of the safety of their house They stood in their houses calling 911 without going to Zimmerman's calls for help. Maybe if one of those upstanding citizens would have gone out and helpped Zimmerman and stopped Trayvon from beating him Trayvon would be alive but no they called 911 and made claims they could not personally know as they didn't see who it was calling out like the eye witness did. :roll:
