Not very often that the courts rule on something before it comes to a vote. Most times the funding has already been approved before the court rules.
Any Rep. or Sen. that votes for funding for an "act" that has already been deemed unconstitutional should be impeached, immediately, no questions asked. If it is appealed and overturned, then you can vote.
Seems fairly simple to me...
