sorry if this was posted before...been staying away from the political BS to ease my troubled mind.... but I saw this on another site and wanted to share the joy that the former first bitch can not be in the fold of the new regime..................

For those of you who may have been concerned at the prospect of Hillary Clinton becoming Secretary of State, you might be able to breathe a little easier tonight.

Our wonderful document, the Constitution, seems to have some pretty good rules in it if you just take some time to read it. It's kinda...you know...the LAW.

Article One, Section Six of the U.S. Constitution says:

No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office.

So, Hillary, as a sitting Senator, cannot accept or assume the office of Secretary of State because the salary for that position increased while she was a Senator. In order for her to be SoS, they would have to change the Constitution, and I don't think Hillary has enough friends to get that one done

Then how did Cheney become GHW Bush's Secretary of Defense :???:

There are a 100 ways around it- and there has been numerous precedent set by both parties.....Cheney is just the one I remember...

This was discussed a few days ago. As OT said, it's been done numerous times on the past and all the appointed person has to do is not accept the pay raise. Hasn't caused any problems yet.

Thing is it should have caused problems, the Constitution is pretty clear. It does not say unless you chose not to take the pay raise. It says you can not hold that office.

Anyone in past or present should not be able to ignore the Constitution just because they take a pay cut.
