Or are they just against the Constitution?

In a statement, ICE officials said releasing suspected undocumented immigrants back into the community poses dangers, both to the public and to the agents, and committed to working with local sheriffs to deport the most dangerous undocumented immigrants.

Pelle in April joined several other Colorado sheriffs in announcing he would no longer honor the ICE requests. The detainers request that sheriffs hold a suspected undocumented immigrant for up to 48 hours beyond their normal release time. Add in weekends and holidays, and 48 hours can stretch to nearly a week, says Mark Silverstein of the Colorado ACLU. Boulder County saw about 150 ICE detainer requests in 2013, Pelle said, out of 10,000 bookings.

"Even 48 hours is a very long time to someone who should be free," Silverstein said. "The government has to have adequate grounds to deprive someone of their liberty. Even for a few minutes, it needs to be justified."

In 2013, ICE freed 36,007 convicted criminal aliens from detention who were awaiting the outcome of deportation proceedings, according to a document obtained by the Center for Immigration Studies. This group included aliens convicted of hundreds of violent and serious crimes, including homicide, sexual assault, kidnapping, and aggravated assault. The list of crimes also includes more than 16,000 drunk or drugged driving convictions. The vast majority of these releases from ICE custody were discretionary, not required by law (in fact, in some instances, apparently contrary to law), nor the result of local sanctuary policies.

Like I've said several times before- this has been going on for the last 30-40 years or longer... Local law enforcement would pick someone up- usually on some misdemeanor state/local violation- notify Border Patrol/Immigration of their suspected illegal status- Border Patrol would come confirm it- and more often than not write the illegal suspect a notice to appear (NTA) before a deportation Judge (often months in the future and several States away)- and they would be released as soon as they served their sentences on the local charges...

Border Patrol claimed they only had enough funding in their budget to deport about 1/2 of the year... And they wanted to maintain enough in the budget to deport those picked up on serious or violent crimes as they were being released from prison...

And according to the Border Patrol/Immigration folks- guess how many written an NTA showed up in court :???:

I think the gist of the story was that ICE was asking sheriffs to hold people 48 hours after they were to be free- therefor against their constitutional rights.

The second post was just showing how willing ICE was again to break the rule of law by releasing those that had actual convictions of wrong doing.

OT will also tell you that states can not have laws, pertaining to detention of illegals, because it is a Federal issue, but here we have the Feds, trying to download the costs...

I recently read an article regarding those that say thinks like ""I said" I"done" Researchers say that people who use I to make themselves look better are self-conscious,,,insecure and looking for attention...Usually they are using the ""I"" to make themselves look more important. This study done by a major University sure points finger at one poster

EH???

How do you figure that? The Feds still need to pay the per diem cost for each Federal prisoner.... In fact if the illegal was in jail on a hold for a state criminal act- the County would not get paid-- but as soon as Immigration filed a detainer, the Feds would be liable to start paying the prisoner cost (which in many areas is a lucrative business) ...

And I don't know why any Sheriff would want not hold an illegal after his normal release time as long as they have a detainer filed by Immigration authorities and signed by an Immigration Judge - unless they already have overcrowding in their jails which is often a problem...
