Sixtieth Legislature First Regular Session 2009

IN THE HOUSE OF REPRESENTATIVES

HOUSE JOINT MEMORIAL NO. 3

BY STATE AFFAIRS COMMITTEE

A JOINT MEMORIAL TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF IDAHO IN THE CONGRESS OF THE UNITED STATES.

We, your Memorialists, the House of Representatives and the Senate of the State of Idaho assembled in the First Regular Session of the Sixtieth Idaho Legislature, do hereby respectfully represent that:

WHEREAS, the Second Amendment of the United States Constitution does not simply provide for a collective right or a right for the states to establish militias; rather it provides for the right of the people to keep and bear arms; and

WHEREAS, the primary purpose of the right to keep and bear arms is to protect one’s self, family and possessions from either the private lawlessness of other persons or the tyranny of government; and

WHEREAS, the right to keep and bear arms is also meant to protect the general private uses of firearms in activities such as hunting and other sporting activities; and

WHEREAS, the United States Supreme Court in District of Columbia v. Heller, 128 S.Ct. 2783 (200, recently struck down a firearms ban in the District of Columbia, explicitly ruling that the Second Amendment protects the right of the people to possess firearms for private use; and

WHEREAS, despite this ruling, legislation has been introduced in the United States House of Representatives calling for a system of mandatory federal licensing of all firearm owners; and

WHEREAS, the legislation introduced would require all firearm owners to apply for and carry a federally issued picture identification in order to keep any firearm in their homes; and

WHEREAS, the legislation introduced would make it a federal crime to keep a loaded firearm or an unloaded firearm and ammunition within any premises including, under certain circumstances, American homes where a child may be present; and

WHEREAS, the legislation introduced specifically purports to preempt any state or local law inconsistent with it; and

WHEREAS, the introduced legislation, Blair Holt’s Firearm Licensing and Record of Sale Act of 2009, is a direct imposition on each American’s individual right to keep and bear arms in their homes and for their protection.

NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session of the Sixtieth Idaho Legislature, the House of Representatives and the Senate concurring therein, that members of the United States Congress cease and desist attempting to enact federal legislation impinging on the individual right of every American to keep and bear arms in any manner. Specifically, that members of Congress oppose the passage of the Firearm Licensing and Record of Sale Act of 2009, and any similar legislation.

BE IT FURTHER RESOLVED that the Secretary of the Senate be, and she is hereby authorized and directed to forward a copy of this Memorial to the President of the Senate and the Speaker of the House of Representatives of Congress, and the congressional delegation representing the State of Idaho in the Congress of the United States.

The majority of these came up with and because of GW's absolute disregard for states rights and states sovereignty- with mandatory Federal programs like the Patriot Act, the REAL ID, and the NAIS Mandatory ID on cattle--plus their intrusion on and threats against the states when they passed laws like the M-COOL laws to identify and promote Montana and USA produced products....

That's funny nothing in the piece from Idaho mentions animal ID. :roll:

Is there anything Bush is Not responsible for?

I do not see a date on this writing, but it is quite interesting that this has come forward now - when there is indeed so much fear from many the general populace - the so called right wing nut faction. Certainly not all of them can be certifiable?

I would not be surprized if there were a great number of States who will - in the near future - start telling your leader to back off and stay out of their yards.

I do not often tell you this OT - but you really must start reading this information and perhaps applying some of it to the new guy in the House and to those Democrats who were sitting when Bush was the Prez.

Even I know a Prez does not have infinite power and I also know he cannot do all the things you have stated without the help of the Congress and the Senate. Seems to me there were a lot of folks from the Dems who were there as well.

Your new Prez does appear to have a real following over here in the middle east - and most of them are not the sort you would want to invite to dinner.

And Hamas has been licking their chops in some serious anticipation since the 900 million dollar aid package was announced.

This is the middle east - do not believe for a second that they will not get their hands on the lions share. No matter what your new prez says.

You need to stop sounding like the entire worlds faults are the result of one man and start realizing that even he had help from some folks who wear the big D on their heart.

You lose a great deal of credibility - something you had in abundance with some not too long ago - when you sound like you do.

It would be nice to actually see a real answer from you once in a while.

No more lectures from me - you will walk your own path.

Don't worry BC, Obama is going to have VP Joe make sure all the money is spent wisely. :wink: :D

It's really not hard to bring a resolution to the floor.

Whether something like this would really pass is another question.

The fact that these resolutions are even being brought up in so many states should tell you something.

As beautiful as the Sand Hills and central Nebraska are, I don't think the political culture there is representative of the nation as a whole.

Add that 28 percent of GDP spent by the U.S. government to the 12
percent spent by states, counties and cities, and government will
consume 40 percent of the economy in 2009.
