DHS Chief Napolitano: Illegal Immigration Is Not a Crime

Homeland Security Secretary Janet Napolitano stunned many listeners during an appearance on CNN when she asserted that illegal immigration is really not a crime.


In an interview with CNN’s John King last week, Napolitano discussed Sheriff Joe Arpaio of Maricopa County, Ariz., a strict enforcer of immigration laws who says he wants illegal aliens to be prosecuted and jailed.


King said: “A lot of Democrats in Congress want you to investigate him. They think he is over the line. He says he is just enforcing the law and the problem is the federal government.”


Napolitano responded: “Sheriff Joe … knows that there aren’t enough law enforcement officers, courtrooms or jail cells in the world to do what he is saying.


“What we have to do is target the real evil-doers in this business, the employers who consistently hire illegal labor, the human traffickers who are exploiting human misery.


“And yes, when we find illegal workers, yes, appropriate action, some of which is criminal, most of that is civil, because crossing the border is not a crime per se. It is civil. But anyway, going after those as well.”


The fact is, crossing the border without authorization is a crime. The statute reads: “Any alien who enters or attempts to enter the United States at any time or place other than as designated by immigration officers . . . shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both.”

Well, I was passing thru the kitchen the other day whe she was talking and I thought I heard this very statement....then I thought, " Nah, surely not".


But I guess I did hear it right.......

There is a spot I really like in Idaho - been there many times - if it is not a crime I think I might just squat there - it is government land and I think I could put a water powered generator up in a couple of hours.

You folks can give me food stamps once my cash runs out but I will always have electrical power.

While I personally think it should be made a crime- Napolitano is right...The Courts, the AG's for several years, and GW have said the same....

Guiliani best described it during the campaign:

It’s not a crime,” Giuliani said. “I know that’s very hard for people to understand, but it’s not a federal crime.”

Giuliani’s comments came in an interview with CNN Headline News and radio talk-show host Glenn Beck.

“I was U.S. attorney in the Southern district of New York,” he said. “So believe me, I know this. In fact, when you throw an immigrant out of the country, it’s not a criminal proceeding. It’s a civil proceeding.”



Illegal immigration shouldn’t be a crime, either, Giuliani said: “No, it shouldn’t be because the government wouldn’t be able to prosecute it. We couldn’t prosecute 12 million people. We have only 2 million people in jail right now for all the crimes that are committed in the country, 2.5 million.”

Attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact;
has committed a federal crime.

Violations are punishable by criminal fines and imprisonment for up to six months. Repeat offenses can bring up to two years in prison. Additional civil fines may be imposed at the discretion of immigration judges, but civil fines do not negate the criminal sanctions or nature of the offense.

Facts will only confuse OT...he has a quote to back his position...all he needs to know he's right!

TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part VIII > § 1325Prev | Next § 1325. Improper entry by alien
(a) Improper time or place; avoidance of examination or inspection; misrepresentation and concealment of facts
Any alien who
(1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or
(2) eludes examination or inspection by immigration officers, or
(3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under title 18, or imprisoned not more than 2 years, or both.
(b) Improper time or place; civil penalties
Any alien who is apprehended while entering (or attempting to enter) the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty of—
(1) at least $50 and not more than $250 for each such entry (or attempted entry); or
(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection.
Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.
(c) Marriage fraud
Any individual who knowingly enters into a marriage for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, or fined not more than $250,000, or both.
(d) Immigration-related entrepreneurship fraud
Any individual who knowingly establishes a commercial enterprise for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, fined in accordance with title 18, or both.

It is very important to understand who Politicians are sending a message out to and why!

If it is not illegal I guess I just wasted a friggen pile of miles and hours driving forty miles around when all I had to do is drive 4 miles across country to visit my parents for the last 30 years, Oldtimer. :roll:

Trust me it is illegal as I have been stopped and questioned by the US Border Patrol more than once as to why I was on a back road south of the border in a Canadian vehicle. And just to easy your mind I had legally entered the US at the Regway Port. Once I told them who I was and where I was going they realized I was telling the truth as they knew my parents and that they had a daughter who lived in Canada.

Anyone that lives close to the border knows it is illegal to just jump across the border. People caught jumping the border are heavily fined and take a chance of loosing the vehicle they are in if not jailed for their actions.
Since 911 people around here are scared that the US border patrol will shoot first and ask questions later if they catch you close to the border. :wink:

Maybe instead of believing anyone you should do a little research and use some common sense before you speak! :roll:

And certainly before you try to correct someone on the subject!

And Thirdly when you have been proved wrong then maybe you should admit it instead of finding a way to blame your ignorance and arrogance on the issue on Bush!
