What the hell is the IRS doing seizing medical records?

Republican members of the House Energy and Commerce Committee are looking into allegations that the Internal Revenue Service seized 60 million medical records from a California health care provider.

“(T)he Committee on Energy and Commerce is investigating allegations that the Internal Revenue Service (IRS), in the course of executing a search warrant at a California health care provider’s corporate headquarters in March 2011, improperly seized the personal medical records of millions of American citizens in possible violation of the Fourth Amendment to the United States Constitution,” members of the committee wrote in a letter Tuesday to Acting IRS Commissioner Daniel Werfel.

The letter to Werfel, which requires a response by June 25, comes on the heels of a lawsuit filed by an unnamed healthcare provider against the IRS in California Superior Court. The lawsuit alleged that 15 IRS agents improperly stole medical records during search of the facility in March 2011, according to a report about the incident from Court House News.

The search warrant did not specify that the IRS could take medical information, UPI said. And information technology officials warned the IRS about the potential to violate medical privacy laws before agents executed the warrant, the complaint said, as reported by UPI.

“Despite knowing that these medical records were not within the scope of the warrant, defendants threatened to ‘rip’ the servers containing the medical data out of the building if IT personnel would not voluntarily hand them over,” the complaint states, UPI reported.

The suit also says IRS agents seized workers’ phones and telephone data – more violations of the warrant, UPI reported.

The complaint alleges the IRS was “invasive and unlawful” and stole access to intimate medical records that included patients’ treatment plans and therapies, UPI said.

The suit seeks $25,000 in compensatory damages, per violation. The records’ seizure could impact up to one in 25 Americans, UPI said.

According to a story by Courthousenews.com, an unnamed healthcare provider in California is suing the IRS and 15 unnamed agents, alleging that they improperly seized some 60 million medical records of 10 million Americans, including medical records of all California state judges on March 11, 2011.

According to the complaint, the IRS agents had a search warrant for financial data pertaining to a former employee of the “John Doe Company,” however, “it did not authorize any seizure of any healthcare or medical record of any persons, least of all third parties completely unrelated to the matter.”

The medical records included information on psychological counseling, gynecological counseling, sexual and drug treatment, and other sensitive medical treatment data, the suit alleges.

“This is an action involving the corruption and abuse of power by several Internal Revenue Service agents,” the complaint reads.

“No search warrant authorized the seizure of these records; no subpoena authorized the seizure of these records; none of the 10,000,000 Americans were under any kind of known criminal or civil investigation and their medical records had no relevance whatsoever to the IRS search. IT personnel at the scene, a HIPAA facility warning on the building and the IT portion of the searched premises, and the company executives each warned the IRS agents of these privileged records,” it continued.

“Despite knowing that these medical records were not within the scope of the warrant, defendants threatened to ‘rip’ the servers containing the medical data out of the building if IT personnel would not voluntarily hand them over,” the complaint reads.

“Moreover, even though defendants knew that the records they were seizing were not included within the scope of the search warrant, the defendants nonetheless searched and seized the records without making any attempt to segregate the files from those that could possibly be related to the search warrant. In fact, no effort was made at all to even try maintaining the illusion of legitimacy and legality.”

sounds like 'alleged" is not quite adequate to explain the complaint...

Don't get your panties in a wad Mike...It's just an allegation...probably some sort of conspiracy theory, where the Health Care company is lying about what the FBI seized.

Yeah, companies frivolouslyously sue the US government all the time because it is so easy to win a case against a government that has unlimited resources.

Yep, probably nothing here.

12/06/2012 Mandate/Prohibition petition denied

maybe someone found a way to get a eligibility case heard?

if it took a IRS agent 'team' to raid a insurance giant to get health records.. then we will never know the motive unless someone talks...
and says that he was threatened by exposing health secrets..

BTW,.. didn't Romney live in California?

There were ALLEGATIONS of the Benghazi attack being a Terrorist attack and Obama, Hillary and Sue Rice claimed it was a spontaneous reaction to a video. BUT
There were ALLEGATIONS of the IRS targeting Conservatives and the head of the IRS testified under oath nothing of the kind was going on. BUT
There were ALLEGATIONS of the DOJ secretly seizing press phone records and Holder testified under oath no such thing was going on. BUT
There were ALLEGATIONS of the NSA were seizing Americans Cell phone and email records and Clapper testified under oath that no such thing was going on. BUT
There were ALLEGATIONS of the HHS was asking the Private sector to fund the implementation of Obamacare and Silbilus claimed otherwise. BUT
There were ALLEGATIONS the Obama Administration was going to be the Most Transparent Administration in History BUT

"Now there is ALLEGATIONS"

We use there is for singular and there are for plural.
There is one table in the classroom.
There are three chairs in the classroom.
There is a spider in the bath.
There are many people at the bus stop.
