The Food and Drug Administration is enforcing a new import alert that greatly expands its curtailment of some food ingredients imported from China, authorizing border inspectors to detain ingredients used in everything from noodles to breakfast bars.
The new restriction is likely to cause delays in the delivery of raw ingredients for the production of many commonly used products.

The move reflects the FDA's growing unease with what the alert announcement called China's "manufacturing control issues" and that country's inability to ascertain what controls are in place to prevent food contamination. For example, the agency says that, after weeks of investigation, it still does not know what regions of China are affected or what firms there are major manufacturers of vegetable proteins.

Inspectors are now allowed to detain vegetable-protein imports from China because they may contain the chemical melamine. Melamine, used in the manufacture of plastics, was found in the wheat gluten and rice protein concentrate that has led to the recall of 5,300 pet food products.

Inspectors said
Melamine's effects on humans, if ingested, is unclear. In fact, the chemical has not been found in earlier tests to be highly toxic, a fact that has scientists looking for second chemical agent that could be increasing its toxicity.

The agency for the first time also said it has received reports, which it has yet to confirm, that approximately 1,950 cats and 2,200 dogs died after eating contaminated food.

An import alert of this breadth is rare. Before this new FDA action, only products from two Chinese companies that exported the melamine-tainted wheat gluten and rice protein concentrate had been detained.

Now for the products to reach U.S. foodmakers, the importers will have to prove to the FDA that they are safe. The ingredients restricted include wheat gluten, rice gluten, rice protein, rice protein concentrate, corn gluten, corn gluten meal, corn by-products, soy protein, soy gluten, mung-bean protein and amino acids.

The new restriction may be what's needed to shore up consumer confidence that the FDA can protect the food supply, said Jean Kinsey, director of the Food Industry Center at the University of Minnesota. Without such action, the public's distrust will grow, she said.

According to the alert notice posted on the FDA website Friday, the agency has so far taken 750 samples of wheat gluten and products made with wheat gluten and found 330 positive for melamine or melamine combined with another substance. It also found 27 positives out of 85 samples of rice protein concentrate and products made with rice protein concentrate.

All of the samples that tested positive were imported from China.

"I don't believe it has reached such a serious stage that human food is at risk," Wu Yongning, Deputy Director of the National Institute of Nutrition and Food Safety, part of China's Ministry of Health, said in Beijing. "Problems occur in all countries."

"Generally speaking, American consumers should not worry too much," said Luo Yunbo, Head of the Food Science and Nutrition Engineering Institute at China's Agricultural University in Beijing. "We select the best products for the international markets."

This may partially explain why Chinese product safety officials have been so sensitive about foreign criticisms. Though they should at least partially shoulder the blame and move on with an eye towards better oversight rather than trotting out excuses that they they were overworked and understaffed due to the rapid fire growth of China's export market.

One of the results of lack of supervision is the rampant amount of pirated goods on the Chinese market today, a situation for which the Chinese consumers themselves should also be blamed given their thirst for flouting western brand names, whether it's a fake pair of Nikes, a phony Dunhill shirt, a bogus Gucci purse, dodgy Oscar de la Renta shades or simply watching a bootlegged Hollywood release on DVD. The prices are cheaper than the real deal and the consumers rarely if ever concern themselves with trademark and licensing issues.

But this mentality also trickles down to the level where Chinese consumers are now literally eating the tainted fruits and ingesting the fake medicines of their own slipshod labors. No greater example can be found than during the traditional Chinese "golden week" holidays (Lunar Chinese New Year), May 1 Labor Day, and October 1 National Day - when fake foods and liquor abound on the Chinese market.

According to Chutian Metropolis Daily, authorities in Enshi city in the central province of Hebei launched a check on the local liquor and wine markets on the eve of the National Day holiday. They found half of the of brand-name Chinese baijiu (white liquor) such as Maotai or Wuliangye on sale in the city were fakes. More astonishing, 90% of the so-called imported brandy, whisky and wine served in entertainment venues and restaurants surveyed were counterfeit. And in Dongguan, a boom city in the southern province of Guangdong, authorities recently smashed a backyard beer brewry that was producing fake brand-name hooch using chemicals harmful to humans.

Some Chinese commentators have pointed out also that the problem isn't just greedy consumers and quick-buck artists - it's also often rooted in the collusion between government officials and entrepreneurs. "The problem is, many restaurants and entertainment places are run or shared by local law enforcement officials," one wrote.

The Cub Scout Totem Badge is the latest Chinese toxic import recalled by the U.S. Consumer Product Safety Commission.

It advised parents to rip the 1.6 million lead-poisoned awards off the uniforms of their seven- and eight-year-old Boy Scouts of America.

Here's what happened: Kahoot Products Inc. of Roswell, Ga. outsourced the manufacture of the Boy Scout badge to a Chinese firm that coated it with paint containing so much lead that it's poison to the American children who had earned the right to wear it.

The stripping of Cub Scout uniforms follows a summer of dogs and cats sickened and killed by melamine-laced pet food from China that was recycled back to livestock after it was recalled.

China fears toxic threat to farmland

China's industrial and urban sprawl has left more than 10% of its farmland contaminated, an official survey shows, while arable areas continue to shrink despite Beijing's efforts to halt the trend.
Pollution combined with the land squeeze poses a "severe threat" to China's ability to feed itself, the official Xinhua news agency quoted an official at the land and resources ministry as saying.

Industrial runoff was one of the chief culprits. Heavy metals alone are said to poison 12m tonnes of grain and cause £1.3bn in losses a year. Abuse of fertilisers was another problem. Officials say toxic grain could become a health hazard.
The report is the latest warning over food security in China, which boasts that it feeds about 22% of the world's population with only 7% to 8% of its arable land.
"The difficulties are becoming more serious, especially as more multinational companies and domestic capital groups look to invest," said Wen Tiejun, an agronomist at the People's University, Beijing.

China had already announced that agricultural land available had shrunk by more than 300,000 hectares in the first 10 months of last year alone to a total of 121.8m hectares.

Beijing is trying to halt the outward sprawl of its cities with a series of restrictions on luxury developments and the use of farmland for housing or industrial zones.

This wheat gluten was subsequently used in the production of pet food in Dec 2006 & Jan 2007.

Judicial Watch Obtains New FDA Documents Re: Abortion Pill RU-486

(Washington, DC) -- Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it recently received 175 pages of new documents pertaining to the abortion pill RU-486 that had previously been withheld by the Food and Drug Administration (Judicial Watch, Inc. v. Food and Drug Administration, et al. (on remand 00-2973)). According to the documents uncovered by Judicial Watch:

• Despite the FDA's refusal to disclose where the abortion pill is manufactured, these documents confirm that the China-based Hua Lian Pharmaceutical Company manufactured RU-486 at the time of approval. This seems to be the first official document confirming that the abortion drug has been manufactured in China.

• The documents indicate that not only did Hua Lian fail its first FDA safety inspection, but that the company was not in compliance with safety requirements at the time the FDA approved the facility for manufacturing on August 15, 2000.

• The documents also show the extent to which the pro-abortion lobby was involved in the approval process. For example, one of the trials used by the FDA to justify its decision was conducted by Dr. Suzanne Poppema, President of the National Abortion Federation. Another trial was performed by Dr. Daniel Mishell, a senior scientist for RU-486's patent holder, the Population Council.

• RU-486 must be used in conjunction with another drug (Cytotec) that is not approved as an abortifacient. According to FDA internal communications obtained by Judicial Watch, the agency knowingly participated in the "off label" use of Cytotec and helped the drug's manufacturer, Searle, craft a letter designed to protect the company from legal liability for the unauthorized use of the drug.

"These documents show the reckless and politicized nature of the FDA's decision to approve the abortion pill," said Judicial Watch President Tom Fitton. "The FDA certainly has a lot of explaining to do. For starters, why has the FDA previously refused to disclose the Chinese connection and the related safety issues? And why did the FDA allow the abortion lobby to participate in the clinical trial process? The American people deserve answers."

Through the Freedom of Information Act and litigation against the FDA, Judicial Watch previously discovered that RU-486 was approved under the "Accelerated Approval of New Drugs for Serious or Life-threatening Illnesses," a measure that was adopted for use in rare cases to encourage the manufacture and importation of drugs designed to treat life-threatening diseases such as cancer or heart disease. Judicial Watch also uncovered clinical trials and other documents that revealed serious health complications resulting from the use of the drug. These documents resulted in calls to recall RU-486 from the market.

....and this is the same FDA the executive branch has filled with its appointees.

How can they ever have the position that prescription drugs from Canada are not allowed--especially when many of those same companies are arms of U.S. companies who make drugs that are shipped back to the USA for sale?

It is plain to see that the this executive branch does not operate off of integrity or ethics or even ideology (except the ideology of money), but on the interests of whoever pays them off. They then try to use every method possible to hide their involvement in covering up these inconsistencies. If a tree falls in the woods and no one is around, there is plausible deniability that there was no sound.

I am beginning to believe that their over riding ideology is, "Do what you can get away with. It is the American way. It is the way towards more profits. Those who have the gold rule, etc."

Sounds so machiavellian. The problem with machiavellianism is the philosophical assumption that there is no greater power than yourself and that your view of "good" is THE view of "good". Everyone with power has had this problem. The Catholic church, kings, queens etc., even (and a more appropriate example) Caesar. Caesar took Rome from being a representative republic to the totalitarian and corrupt state it turned into.

Everyone finds out that that their view is not THE VIEW in the end. The machiavellian ways of Hitler is a prime example. The problem is that there are a lot of innocent people who pay the price along the way.

Democracy requires transparency to avert self serving interests of those in power. It also requires the rule of law and ethics in our leaders.

The example you bring up here, OT, has profound implications for our democracy if it is not quickly corrected and people held responsible.

As I am writing this, I am hearing an argument by sr. democrats and sr. republicans in the House about how the other party did the deed (in this case it is protecting administration and party officials) and so it is unfair for the other party to expect accountability when the other party did the same thing in the last administration--debating about investigating Iraq corruption.

There is no accountability for politicians. The two parties put their self interest before the interests of the country continually.

Food Safety Worries from Foreign Imports Cause Consumers to Turn to U.S. Grown and Processed Foods

JOHNSON CITY, Tenn., Oct. 17 /PRNewswire/ -- Ask most restaurant chain executives or the owner of your neighborhood deli what keeps them awake at night and chances are they will tell you their worst nightmare is serving their customers a food-borne illness.
Tainted catfish and pork from China are only a few of the food scares of 2007 that have raised concerns among restaurant operators and their customers. One survey of consumers last month by American Express found that 40 percent of U.S. consumers avoid purchasing food products from certain countries. A recent report on food safety by Technomic, a leading restaurant industry research firm, found 38 percent of American consumers "extremely concerned" about food safety. The report cited the increase could be due to reports about tainted Chinese food imports.

A new survey of restaurant operators proves that restaurants are turning toward U.S. grown and processed foods for their customers. The survey, conducted by Restaurants & Institutions magazine asked restaurant operators whether they prefer U.S. or imported foods for their customers. Less than 14 percent said they preferred imported foods while more than 60 percent said they would be more likely to buy foods they know were grown and processed in the U.S. This reverses a trend toward cheap imports and a perception that customers might perceive imported foods offering more authentic flavor.

"We have seen extraordinary demand for our flame-roasted peppers by restaurants this year," said Stanley Dunbar, chief executive officer of family-owned Moody Dunbar, Inc. "Restaurants want the assurance that the roasted peppers they serve to their customers are grown and processed to a much higher standard of quality and safety." "In the past, some operators went for the cheapest imports to save money. Today, restaurants are willing to pay a few pennies more for food they know is safer."

Dunbar''s company grows its bell peppers in California, then flame-roasts and processes them for restaurants and supermarkets to much higher government and industry standards than found in foreign countries. "The mentality that low price is the only factor restaurants consider in determining what they buy is ending," Dunbar said. "Restaurant chains know that one food-borne illness can destroy their reputation with their customers they''ve worked decades to build."

Consumers are also more concerned about the origin of their foods from supermarkets and restaurants. USA Today reported in July that 80 percent of Americans now check food labels. While many are checking for fat and calories, others are checking to see where the food was grown.

For example, a recent check of a food label on a jar of mandarin oranges by a trusted U.S. brand found that their oranges were grown in China, and then processed in Thailand. Thus, even U.S. brands may include product grown elsewhere under less stringent food safety regulations.

While restaurants are not yet required to offer information to their customers as to the origin of their foods, it may be on the horizon. For Stanley Dunbar, his company is ahead of the curve. "We''ve been labeling our supermarket and restaurant products for years. Just look for the image on the can or jar that reads ''Proudly Grown And Processed In The U.S.A.''"

Trader Joe's just says no to China

Trader Joe's, the hip, wholesome food store with 15 locations in the Chicago area, said Friday it will phase out foods imported from China amid concerns that standards on "organic" products from the country aren't as stringent as they should be.

Alison Mochizuki, spokeswoman for the Monrovia, Calif.-based grocer, e-mailed a statement saying the grocer will phase out single-ingredient products from mainland China by Jan. 1.

Trader Joe's will be phasing out all foods made in China from stores in Chicago and around the country.

"We feel confident that all of our products from China meet the same high quality standards that we set for all of our products," the statement read. "However, our customers have voiced their concerns about products from this region and we have listened.

"We will continue to source products from other regions until our customers feel as confident as we do about the quality and safety of Chinese products."

Trader Joe's is owned by German billionaires Karl and Theo Albrecht, who also own the Aldi food chain.

The change apparently does not affect products containing multiple ingredients, of which some may be from China. Mochizuki declined to comment further.

Whole Foods has no plans to stop selling single-ingredient products from China, which make up "a very small percentage" of the grocer's private label products, spokeswoman Kate Klotz said in a prepared statement. The company has processes in place to ensure quality, she said.

Trader Joe's move follows criticism of what's perceived as gaps in the system for verifying organic imports.

China has been faced with a number of exporting scandals recently. In addition to lead-laden kiddie jewelry and toys, Chinese manufacturers have been blamed for selling pet food tainted with the industrial chemical melamine and for exporting contaminated toothpaste. China also famously exports counterfeit consumer goods, from fake designer handbags to phony computer software.

Concentrating all that wealth to the top will not produce consumer demand in China for our products. The regular people will not have the money to buy our goods. A mercedes might get sold to the guy at the top, however.

Another China product BITES the DUST

As of this morning, PetSmart has pulled various Smokehouse Brand dog treats off of their shelves. There have been reports of pets becoming ill after eating the treats, and as a precaution, PetSmart has removed the products. There has been no formal recall as of yet.

Here is what the PetSmart corporate office released to the PetSmart stores:

"Today the American Veterinary Medical Association (AVMA) issued a media alert warning some treat products from China may be a potential threat to pets due to 'several complaints from pet owners and veterinarians of illness in dogs.' No deaths have been reported at this time. The symptoms of pets reported sick were vomiting, lethargy and anorexia. To date, testing by the FDA and PetSmart Techinical Services has ruled out melamine contamination that might be making pets sick.

For now, we're going to take the precautionary measure to pull this product from the shelves and contain it in the backroom. Our experts will continue to monitor the situation, analyze samples for a variety of possible problems and ask the vendor to test additonal product. Because of the relatively small number of complaints at this point, we're not issuing a recall. We'll provide timely updates as more information becomes available."

The acting chairperson of the Consumer Product Safety Commission, Nancy A. Nord, has requested lawmakers not to approve legislation that would augment the commission's authority and increase its budget and staff.

According to a report in the Times, Nord is against measures that would hike penalties for safety violations, protect industry whistle-blowers, and prosecute company executives when laws are breached.

The laws are part of an effort to strengthen the commission at a time when a raft of tainted goods are entering the U.S market.

Nord, in a letter to Democatic leaders in the consumer affairs subcommittee, opposed banning lead from all toys, saying it was not practical. SO which CHI COM paid her OFF?

She also said that a proposal to raise the cap on maximum penalties from $1.8 million to $100 million "may have the undesired consequence of firms, as a precautionary measure, flooding the agency with virtually every consumer complaint and incident." Her concern, she said, was that the increase in complaints would so overwhelm the commission that, "true safety issues would go unrecognized in the process," the New York Times reported.

I saw Nord on C-span this morning. Interesting interview.

Her point was that she needed less attorneys and more on the ground inspectors.

The problems with her positions stem from the fact that they seem inconsistent. Congress asks to throw money her way and she rejects it (that may be a good thing in some cases). ANY TIME a regulatory agency reduces its contact with the public just so it isn't over burdened there is a problem. The information needed for her to do her job comes from these complaints. The public catches problems that her agency and industry do not catch.

She also wanted a more limited liability for importers (I guess in the way of fines?) than what Congress wanted. Even if there were higher fine limits, they would not have to be exercised, so why put such a low cap on these fines for companies who sell defective or dangerous products?

One of the things Congress is starting to understand is that the economics of regulatory agencies and the administration of justice need to be addressed.

If it is not economically feasible to enforce a law, it won't be. Costs extraneous to the damage like court costs, are part of that mix. Companies have found that they can get away with a fraud if the recovery costs are higher than the recovery of damages. Fraud a little to a lot of individuals is easier to get away with than a big fraud all at once. The little frauds are not worth the time or effort of correcting and so are not. Collective actions in the form of class action civil suits are costly, and often do not pay those who are damaged (lawyers like John Edwards are able to get rich off of this system).
