Obama to Regulate Farmers, Ranchers and Gardeners - fast tracking HR 875 and Senate 425
Bill HR 875 and Senate Bill 425, The Food Safety Modernization Act of 2009, introduced by Representative DeLauro who is married to Stanley Greenburg an executive of agricultural giant Monsanto. The Food Safety and Modernization Act of 2009 is sponsored by several Agriculture giants including Monsanto, Cargill, Tyson and ADM.
The idea behind the law is to provide the government the ability to trace every aspect of food from where it is grown, grows or is caught to where it is consumed. The Bill allows the government to completely regulate and trace every aspect of how food is handled. It allows the government to regulate and trace what chemicals and fertilizers are used in growing food and to mandate the use of certain pesticides and chemicals to keep the food to government quality and safety standards. It allows the government to mandate the use of hormones, vaccines, medicines and chemicals for those who raise animals. The rules will apply equally to farmers, ranchers, fishermen, butchers, bakers, and etc. The Bill mandates keeping samples and records so that compliance with the new federal rules can be audited and verified. For "free roaming" animals such as cattle, it may require 24 hour GPS tracking.
Under the Bill, the Department of Agriculture would have the power to inspect farms, gardens, ranches, fishing boats, hotdog stands, vegetable markets and etc., at will. They would have the power to demand the production of records and samples at will from those growing, catching or handling food. The Bill binds State Agricultural departments to enforce the new Federal regulations and will supersede many state agricultural laws.
The penalties for non-compliance are draconian including the power to seize land, impose criminal penalties, impose fines up to $1,000,000. The Bill even applies to gardeners who could have their homes and gardens seized and could be fined.
The rules if enforced would effectively end organic farming by small farmers, it would drive out of business most small ranchers or anyone who could not keep the requisite records, store the requisite samples or keep up with all the minutia of thousands of pages of government regulation that will have to be written for this law.
Why is Obama fast tracking this law with all the rest of the stuff he is pushing through? One of the reasons is that if small farmers and ranchers are driven out of business, it would allow large agricultural companies that have the legal teams, crop scientists and other resources to comply with the law a huge competitive advantage. It would reduce the competition from small vegetable growers to the large agricultural business. The law would drive demographic or population changes favorable to democrats. It would cause small farmers and ranchers who vote Republican to be forced off the land and into cities. Therefore, the law greatly benefits the large agricultural companies who were major benefactors to President Obama and Democrats in the last election and it benefits the Democratic party in general.
