I had a hunch, so I did a little quick research. Remember the Kelo v New London ruling a few years ago where the Supreme Court decided that private property can be confiscated so a supermarket can be put in - the one that caused many states to quickly enact stronger laws so exactly that could not happen? Look who voted for that;

"On June 23, 2005, the Supreme Court, in a 5–4 decision, ruled in favor of the City of New London. Justice John Paul Stevens wrote the majority opinion; he was joined by Justices Anthony Kennedy, David Souter, Ruth Bader Ginsburg and Stephen Breyer."

Compare that list to the justices who voted to give the rag-heads in Gitmo rights that the Constitution does not give them; Kennedy, Souter, Ginsberg, Breyer, Stevens.
