Missouri Votes to Block Health Insurance Mandate

JEFFERSON CITY, Mo. -- Missouri voters on Tuesday overwhelmingly rejected a key provision of President Barack Obama's health care law, sending a clear message of discontent to Washington and Democrats less than 100 days before the midterm elections.

With about 70 percent of the vote counted late Tuesday, nearly three-quarters of voters threw their support behind a ballot measure, Proposition C, that would prohibit the government from requiring people to have health insurance or from penalizing them for not having it.

That would conflict with a federal requirement that most people have health insurance or face penalties starting in 2014.


Tuesday's vote was seen as largely symbolic because federal law generally trumps state law. But it was also seen as a sign of growing voter disillusionment with federal policies and a show of strength by conservatives and the tea party movement.

Legislatures in Arizona, Georgia, Idaho, Louisiana and Virginia have passed similar statutes, and voters in Arizona and Oklahoma will vote on such measures as state constitutional amendments in November. But Missouri was the first state to challenge aspects of the law in a referendum.

Federal courts are expected to weigh in well before the insurance provision takes effect about whether the federal health care overhaul is constitutional.

The intent of the federal requirement is to broaden the pool of healthy people covered by insurers, thus holding down premiums that otherwise would rise because of separate provisions prohibiting insurers from denying coverage to people with poor health or pre-existing conditions.

But the insurance requirement has been one of the most contentious parts of the new federal law. Public officials in well over a dozen states, including Missouri, have filed lawsuits claiming Congress overstepped its constitutional authority by requiring citizens to buy health insurance.

The Missouri Hospital Association spent $400,000 warning people that passage of the ballot measure could increase hospitals' costs for treating the uninsured, but there was little opposition to the measure from either grass-roots organizations or from the unions and consumer groups that backed the federal overhaul.

I guess the people of Missouri would rather have the government take care of the uninsured. It would be a shame if the uninsured became insured and had to start paying for thier own healthcare.

Motor Vehicle Liability Insurance is NOT really mandatory anywhere.

NO ONE has to buy it at all. People get around it by not owning a Motor Vehicle or just not buying it period.

Insurance companies do not like Forced Auto Insurance in any form. When it is made mandatory, they are forced to insure people that have poor driving records. We just went through that ordeal here in Al..........and many still don't have any insurance.

I have a claim against a guy who ran through my office property just 6 weeks ago that didn't have insurance. MANDATORY DOES NOT WORK!

Besides, healthcare costs are through the roof because of Gov't intervention and regulations........................................ They need to get the hell out of the way!!!!!!!!!!!!!!!!!!!!!

OMG making vehicle insurance manditory is a lot different than making Health insurance manditory. Or did you forget that you can choose not to have a vehicle if you can't afford to insure it. That is not the case with HEALTH INSURANCE that is made manditory. :roll:

It isn't unconstitutional until at least five black robes say so. Pasty white bankers opinions from podunk Nebraska don't matter.

No because its considered a tax- and thats how they get around it...Just like every cattle owner has to pay a "checkoff" tax when he sells cattle...As a fee it was going to be ruled unconstitutional- but as soon as USDA and NCBA changed their court argument to it being a "tax"- it passed SCOTUS with flying colors....

Okay. You should pass that idea along then to some of your buddies at the State Capitol.

Make every citizen of age buy auto liability insurance, even those who don't own cars.

It would certainly bring down the rates of those who do own cars.....that is as long as the evil insurance companies will share the gains.

I guess the real question for our board members defending obama care and mandated health insurance.. do you and all in you family have comprehensive health care coverage now?

BTW.. I do.. my son recently went off our policy... so he does not..

he can get a basic plan for a little less then $200 a month.. ($2400 a year)
that cover little to nothing and caps at $15,000

Plan Type PPO Deductible $2,500 Coinsurance 30% Office Visit $25
# Prescription Drugs: Not Covered

so really it is just a basic liability plan... and in a real medical emergency it will not cover much... clearly not comprehensive coverage..

so my question is.. . do you and all in you family have comprehensive health care coverage now?

The president fired back by stating, "My critics say everything is a tax increase," and when once again asked if he rejected the notion that the mandate was a tax increase, he said, "I absolutely reject that notion."

NCBA didn't want to call the Checkoff fee a tax either- but it was the only way to pass the Constitutional test of a mandate....
