Sec. 301. National anthem
(a) Designation.–The composition consisting of the words and music
known as the Star-Spangled Banner is the national anthem.
(b) Conduct During Playing.–During a rendition of the national
anthem–
(1) when the flag is displayed–
(A) all present except those in uniform should stand at
attention facing the flag with the right hand over the heart;
(B) men not in uniform should remove their headdress with
their right hand and hold the headdress at the left shoulder,
the hand being over the heart;[/n] and
(C) individuals in uniform should give the military salute
at the first note of the anthem and maintain that position until
the last note; and
(2) when the flag is not displayed, all present should face
toward the music and act in the same manner they would if the flag
were displayed.

Traditionally, members of the nation's veterans service organizations render the hand-salute during the national anthem and at events involving the national flag while wearing their organization's official head-gear. The National Defense Authorization Act of 2008 contained an amendment to allow un-uniformed servicemembers, military retirees, and veterans to render a hand salute during the hoisting, lowering, or passing of the U.S. flag. A later amendment further authorized hand-salutes during the national anthem by veterans and out-of-uniform military personnel.

Have a look at the photo from the October 1, 2007 edition of "Time." It shows Obama, Hillary and Bill Richardson at the Steak Fry of Sen. Tom Harkin (D-Iowa) on September 17 in Indianola, IA during the National Anthem. Richardson and Clinton have their hands on their heart. But not Obama. Does he perhaps believe that, like wearing the flag pin, the hand on the heart isn't "true patriotism"?

while many of US learned the proper protocol in the early days of our education at public schools... Obama was attending a foreign school. so it is not part of his "natural self" and our custom and protocol that is natural for US, is foreign to him..
so sometimes Obama remembers to act like a good patriotic American and at others he stands idle and waits for US to finish our customs..
