Obama’s Cheney Dilemma

When Bush/Cheney started trying to take dictatorial power- and even the Republican Congressmen recognized they were no longer following the laws Congress passed- they appointed a special "bipartisan" commission to look into limiting Presidential Powers... I believe ex Senator Bob Dole was the Chair or co-Chair...
They have come up with many recommendations they are going to recommend become law- or be changed by Constitutional Amendment...Especially on the Presidents ability to bypass or not enforce laws or parts of laws just by finding some two bit attorney that will write an opinion for him that its OK...

My understanding was that prior to the election both McCain and Obama agreed to abide by the recommendations of the comission...Altho as testimony in Congress said- he wouldn't have to- and GW's setting precedent would make it even harder in the future to impeach a President for abusing those powers... One of the reasons so many thought Bush should be impeached- to stop it from setting a precedent for down the line......

I thought the article was quite balanced. If you read The Dark Side, you'll read about the handful of attorneys who Cheney was able to get to do pretty much whatever he wanted. I'm no fan of lawyers and what the article says about young lawyers in the Government I have found to be true. It's well known that the current head of DHS brought in a bunch of 28 year lawyers who sometimes make more trouble than they fix, due to inexperience and love of The Law.

Yep-- the attorney that wrote the opinion that Bush used to completely avoid enforcing the high majority passed law outlawing Mexican truck drivers and trucking firms from operating in the US looked like he was about 18-- and Senator Dorgan tore into him-- and chastised him royally about thinking he could get ahead by being the only attorney that the Administration/Bush could get to write such an obnoxious/offensive opinion- to satisfy and kiss the rear end of the President...As Dorgan said- if you think thats going to get you ahead in your legal career in Washington- you've got another think coming.. :wink:
