Obama breaks the law by releasing 5 Afghan detainees

WASHINGTON (AP) — Two Republican lawmakers on Saturday accused President Barack Obama of breaking the law by approving the release of five Afghan detainees held at Guantanamo Bay, Cuba, in exchange for a U.S. soldier believed held by Islamist insurgents for five years.

The White House agreed that actions were taken in spite of legal requirements and cited "unique and exigent circumstances" as justification.

Sgt. Bowe Bergdahl, 28, of Hailey, Idaho, was handed over to U.S. special operations forces by the Taliban. In return, five Afghans who were held at a U.S. detention facility in Cuba were released to the custody of the government of Qatar, which served as a go-between in negotiations for the trade.

Rep. Howard "Buck" McKeon of California and Sen. James Inhofe of Oklahoma said in a statement that Obama is required by law to notify Congress 30 days before any terrorists are transferred from the U.S. facility. They said Obama also is required to explain how the threat posed by such terrorists has been substantially mitigated.

McKeon is chairman of the House Armed Services Committee. Inhofe is the top Republican on the Senate Armed Services Committee.

In response, the White House said it moved as quickly as possible given the opportunity that arose to secure Bergdahl's release. Citing "these unique and exigent circumstances," the White House said a decision was made to go ahead with the transfer despite the legal requirement of 30 days advance notice to Congress.

While saying they celebrate Bergdahl's release, McKeon and Inhofe warned that the exchange "may have consequences for the rest of our forces and all Americans."

"Our terrorist adversaries now have a strong incentive to capture Americans. That incentive will put our forces in Afghanistan and around the world at even greater risk," they said.

Senate Majority Leader Harry Reid, a Nevada Democrat, said in a statement that "the safe return of Sgt. Bowe Bergdahl is an answer to the prayers of the Bergdahl family and a powerful reinforcement of our nation's commitment to leave no service member behind."

I'm glad for the soldier and his family that he is coming home.

The Muslim in chief is now negotiating with terrorists. I guess that is not too
surprising.

The only reason this happened is to cover his backside!

I thought it was a well-known fact that (up to Obama's reign) the USA NEVER negotiated with terrorists.


I guess you have forgotten the whole Iran-Contra arms for hostages scandal. Don't feel bad Reagan forgot all about it too.

While Obama had to read the newspaper to know what was going on in America. Of course, the paperboy missed getting him a few issues...

and despite that devastating disease, Reagan was STILL a better president and more respected then Obama.

Among the five: a Taliban deputy intelligence minister, a former Taliban interior minister with ties to al-Qaida leader Osama bin Laden and a figure linked by human rights monitors to mass killings of Shiite Muslims in Afghanistan in 2000 and 2001.

In 2012, Rolling Stone magazine quoted emails Bergdahl is said to have sent to his parents that suggest he was disillusioned with America's mission in Afghanistan, had lost faith in the U.S. Army and was considering desertion. Bergdahl told his parents he was "ashamed to even be American." The Associated Press could not independently authenticate the emails.

What a friggin joke Obama doesn't leave a man behind when it comes to releasing 5 high valued terrorists to save a single soldier that went bad by most counts. But when it came to Benghazi and sending in the forces to protect proud US loving men including an Ambassador well the terrorists get to walk free there too. :mad:

It is time to impeach but I doubt Boehner has the balls to actually do what is right. Boehner needs to be gone when the Republicans take the Senate so he is not standing in the way of dealing with this corrupt Administration.

It always amazes me when an Obama supporter talks about what other presidents did or didn't know, considering all the scandals Obama claims he knew nothing about until he read them in the paper. You would have thought after he got caught looking like an total idiot after the first scandal he would have cleaned house on anyone not advising him on what his Administration was really up to and if not after the first surely after the second time he had to admit how UN-INFORMED he is on the workings of HIS GOVERNMENT. :roll:


It also amazes me when a Democrat claims a Republican candidate for President is not experienced enough to run considering they proudly elected a Community organizer/junior senator that couldn't organize himself out of a wet paper bag, entirely due to his skin color. :roll:

How far are you Dems going to go to defend your hero Obama before you realize he is destroying the US Constitution on a daily basis. Will it be when these 5 Obama released Gitmo detainees hit the terrorists most wanted list again for killing even more Americans or maybe when Bergdahl and his Muslim loving daddy take actions to show everyone just how disillusioned they are with the US. If the five former Gitmo detainees kill one honest proud US soldier due to Obama's deal to get back Bergdahl after he walked on his responsibilities to the military and supposedly got captured by the Taliban, somebody will have to answer to this dirty quickie non Congressional approved Obama deal, but I doubt anyone will be held accountable as being held accountable by this Administration is a TOTAL JOKE. :mad:
