I might explain. Obamacare is in a lawsuit for being "Unconstitutional".

The Buckwheat admin is saying that it is not "Unconstitutional" because the mandatory health care, and the penalty of having none is no difference than a tax.

The Judge differs in saying that it is not merely a tax and the "Constitutionality" of it is allowed to be argued in court.

"Not a tax" is a good thing............................................

I thought we had argued this here before and OT adamantly described ObamaCare a no different than a "Tax".

This Judge does not agree with that notion.

Since the judge deemed it not a tax then he should also have to deem it unconstitutioal as the fine for not buying something is considered a penalty. And nowhere in the Constitution does it give the Federal government a right to force somebody to buy something under penalty of law. If one part of the bill is ruled unconstitutional, then the whole bill is null and void as there is no provisions in the bill to allow one part to be rule illegal and let the rest of the bill stand.
You can guarantee that this will be appealed all the way to the Supreme Court but if it is not a tax like the Judge ruled and Obama claimed when he was trying to sell the US voters on it then it should still be found UNCONSTITUTIONAL.

George Stephanolopous (sp) once even presented Odumbass with the Webster's definition of "Tax" and he still wouldn't accept it.
