Scandal: The president illegally asserts executive privilege to protect an attorney general who's either a clueless political hack, malevolent or both, withholding answers of who is responsible for a Border Patrol agent's death.

President Obama's contempt for the rule of law hit a new low when, on the eve of a vote to hold Attorney General Eric Holder in contempt of Congress, he granted his AG's 11th-hour request to hide sought-after documents on Operation Fast and Furious under the cover of executive privilege.

"I write now to inform you that the president has asserted executive privilege over the relevant post-Feb. 4, 2011, documents," Deputy Attorney General James Cole says in a letter that GOP Oversight Committee Chairman Darrell Issa received just before Wednesday's hearing and vote, a letter that apparently was not mentioned in a last-minute meeting between Issa and Holder Tuesday night.

Or maybe it wasn't the 11th hour at all, but just a long-planned final gambit in the cover-up of who made the decisions in a federally sponsored effort to provide Mexican drug cartels with sophisticated American firearms and who is ultimately responsible for the murder of Border Patrol agent Brian Terry with these weapons?

As Fox News anchor Brit Hume recently noted, speaking of Fast and Furious on the web-exclusive "Panel Plus" segment of "Fox News Sunday," "The stench of cover-up on this gun-running operation is very strong indeed."

Executive privilege, as Issa noted in his opening remarks, can only be asserted when it involves direct presidential decision-making and communications. It cannot be invoked, legally, to prevent others in the chain of command from explaining their actions or responding to requests for information on their decisions in which the president is not involved.

Back in February 2011, Assistant Attorney General Ron Welch, in response to the investigations by Rep. Issa and Sen. Chuck Grassley of the Fast and Furious gun-"walking" program run out of ATF's Phoenix office, wrote a letter stating that the "allegation that ATF 'sanctioned' or otherwise knowingly allowed the sale of assault weapons ... is false."

Later, Deputy Attorney General Cole, in another letter to Congress, wrote: "Facts have come to light during the course of this investigation that indicate the Feb. 4 letter contains inaccuracies." In other words, the Department of Justice lied to Congress. The cover-up continues with the invocation of executive privilege.

Committee member Rep. Patrick Meehan, R-Pa., spoke in written remarks about the active intimidation of ATF agents and potential witnesses in the Fast and Furious probe by high officials at the Department of Justice. As we have reported, some ATF agents have already testified that Fast and Furious and its variants were no accident.

"Allowing loads of weapons that we knew to be destined for criminals — this was the plan," ATF Agent John Dodson told Issa's committee. "It was so mandated." ATF agent Olindo James Casa said that "on several occasions I personally requested to interdict or seize firearms, but I was always ordered to stand down and not to seize the firearms."

Fast and Furious has become worse than Watergate. No one died at Watergate. Just what is in those documents that Obama and Holder so desperately want to hide? Brian Terry's family and the American people deserve answers.

Yeah, well, it's not Bush that's on the hot seat. Remember, he is
no longer the president. If what he did was try to cover up something,
the msm would have been all over it. And a border guard must not
have been killed under his watch.

And if he did something wrong, two wrongs don't make a right.

This F&F has been fishy since we first knew about it, and thanks to
that ATF guy, we do know about it. I'd like to be a mouse in the
corner in the White House about now.

Funny how you forgot to post the fact Clinton the Democrat President asserted Privilage 14 times. :roll:

That aside how many times it has been asserted does not change the fact that Obama after 18 months of Holders stonewalling the Oversight Committee asserted it in the 11th hour in hopes of protecting Holder from a Contempt charge. If Obama had nothing to do with Fast and Furious why is he now stepping in other than to protect Holder as Holder has been lieing about OBAMA'S INVOLVEMENT. Holder has been caught redhanded lieing and had to retract those lies. So why hasn't he been charges with Lieing to a Congressional Hearing anyone else would be?

Thus, in some instances, it is not totally clear when a claim of privilege by a subordinate was orally directed by the President even if it was shortly withdrawn...

Every President since Washington has invoked executive priviledge.

But there is criteria to invoke executive priviledge and embarrassment and incompetence is not one of them.

obama is the first to do so, for the reasons he is.

Jaime Zapata was born in Brownsville, Texas, United States, a border city directly north across Matamoros, Tamaulipas, Mexico. He was one of five brothers, all in the field of criminal justice.[5] Zapata attended Hanna High School, and later graduated from the University of Texas at Brownsville in 1995, where he attained a degree in Criminal Justice and an associate's degree in Applied Science.[6] Zapata then joined Homeland Security Investigations in 2006, after being assigned to the Office of the Deputy special agent in Laredo, Texas, where he served on the Human Smuggling and Trafficking Unit[7] and in the Border Enforcement Security Task Force.[8]
Death

Two U.S. Homeland Security Investigations Special Agents, Jaime Zapata and Víctor Ávila, were traveling from Laredo, Texas to Mexico City on an assignment for U.S. Immigration and Customs Enforcement.[9] As they drove through the northern state of San Luis Potosí, the agents noticed two SUVs following them down Highway 57, a four-lane, federal highway from Mexico City to Monterrey. The two vehicles that came up behind them were at a high rate of speed, and were described as driving "aggressively," according to agent Ávila.[10] One vehicle passed the agents' Suburban, while other gunmen started to fire at their vehicle, and eventually rammed them off the road. As one of the agents rolled down the window to inform them that they were U.S. diplomats, the agent recalls how one of the gunmen got off his vehicle, with an assault rifle in his hand, forced the door of the agents' car open and shot point blank at them. When Zapata shifted the vehicle into park, its doors automatically unlocked. The Zeta gunmen pulled open the driver's side door and tried to drag Zapata out, but he fought them off, managing to re-lock the doors. The agents, however, managed to crack the windows to talk with the assailants and identify themselves. The agents hoped to reason with the gunmen—as many as 15 of them—who surrounded the vehicle. According to congressman McCaul, the agents said "We're Americans, we're diplomats", and the response from the drug cartels was bullets.[11]

The gunmen then fled, and Ávila was able to use his cellphone to call for help. Dying, Zapata managed to put the car in gear and drive away before collapsing at the wheel.[12] Soon afterwards, a Mexican federal police helicopter arrived where the two agents were. Ávila was shot twice in the leg, and was later sent to a hospital in the Houston, Texas.[13] Jaime Zapata, however, gravely injured from three bullet shots, died before the authorities could aid him with medical treatment. According to federal sources, the ambush took place at a fake military checkpoint established by the gunmen, who were dressed in camouflage uniforms and armed with machine gun

Five months after the slaying of Jaime Zapata, a report from the White House noted that Zapata's family demanded to know the source of the weapons used in the attack. The gun that killed Zapata and wounded Víctor Ávila—a semi-automatic WASR-10[19]—was purchased by Otilio Osorio in the Dallas, Texas,[20][21][22] the serial number obliterated, and smuggled into Mexico along with nine additional rifles. Congressional investigators have stated that Osorio was known by the ATF to be a straw purchaser months before he purchased the gun used to kill Zapata, leading them to question the Bureau's Operation Fast and Furious leading to the illegal purchase and export of the murder weapon.[23]

Border Patrol Agent Brian Terry was shot and killed near Rio Rico, Arizona, while attempting to apprehend a group of armed subjects. The suspects had been preying on illegal immigrants with the intent to rob them.

Agent Terry and several other agents were attempting to arrest the group when shots were exchanged between the suspects and agents. Agent Terry was struck in the pelvis by a round fired by a suspect armed with an AK-47.

The wounded agent was flown to a hospital where he succumbed early the following morning.

Four members of the group were taken into custody and at least one suspect remains at large.

Agent Terry was a U.S. Marine Corps veteran and had served with the United States Border Patrol for 3.5 years. He had previously served as a police officer with the Lincoln Park, Michigan, Police Department. He is survived by his parents, brother, two sisters, five nieces, and one nephew and is buried in Michigan Memorial Park, Flat Rock, Wayne County, Michigan.

In relation to Agent Terry's murder, the ATF and the Justice Department have now admitted that some of the weapons found at the scene are from the notorious Operation Fast and Furious which delivered guns into the hands of Mexican drug cartels. This operation has turned into a gigantic clusterfark that's now resulted in at least one, possibly two, federal agents' deaths (the other being Jaime Zapata):

After Terry was shot, two AK-47 rifles found at the scene were traced to purchases from an Arizona gun store that was being monitored by ATF in an investigation known as Operation Fast and Furious.

Several dozen so-called straw buyers have been indicted in that case, accused of buying firearms from Arizona dealers and shipping them to narcotics cartels in Mexico.

As part of that investigation, federal whistle-blowers allege that the Department of Justice allowed hundreds of guns to be "walked south" in the hope of tracking them to Mexican kingpins.

While facing heated questioning from Texas Republican Rep. Ted Poe, Attorney General Eric Holder conceded more deaths are likely to result from the failed Operation Fast and Furious gun-walking program. The exchange occurred during a House Judiciary Committee hearing on Thursday.

"Would you agree that this operation was reckless?" Poe asked Holder. "Was it a reckless operation on the part of the United States?"

"I think the way it was carried out, I would certainly say it was flawed," Holder responded. "Reckless? Yeah, I'd probably agree with that. I mean, it was done inappropriately and has had tragic consequences, and as I said in my opening statement it is going to continue to have tragic consequences."

"More people are going to die, probably," Poe interjected.

"Unfortunately I think that's probably true," Holder admitted.

Mexico still waiting for answers on Fast and Furious gun program
Top Mexican officials say the U.S. kept them in the dark. One official was stunned to learn that the cartel hit men who killed her brother had assault rifles from Fast and Furious in their arsenal.

By late last year, however, with the kidnapping of Mario Gonzalez and tracing of the AK-47s, some ATF officials were beginning to tell their superiors that it was time to inform the Mexicans.

Carlos Canino, an ATF agent at the U.S. Embassy in Mexico City, warned headquarters that failure to share the information would have dire consequences for the U.S.-Mexican relationship.

"We need to tell them [Mexico] this, because if we don't tell them this, and this gets out, it was my opinion that the Mexicans would never trust us again," Canino testified to congressional investigators in Washington.

Morales told The Times. "They haven't admitted to us that there might have been permitted trafficking. Until now, they continue denying it to us."

In March, after disgruntled ATF agents went to congressional investigators, details of Fast and Furious began to appear in The Times and other U.S. media. By then, two Fast and Furious weapons had been found at the scene of the fatal shooting of a U.S. border agent near Rio Rico, Ariz.

As well, a second agent had been killed near the Mexican city of San Luis Potosi, sending the ATF hierarchy into a "state of panic," ATF supervisor Peter Forcelli said, because of fears the weapons used might have arrived in Mexico as part of Fast and Furious.

Canino testified that Fast and Furious guns showed up at nearly 200 crime scenes.

Border Patrol Union about it and he said some people had been
moved around, but no one had been fired. :mad:
