I defended the fact that the Judge accepted the plea bargain agreement offered by the prosecution because according to some I had talked to directly involved in the case said they did not believe they could get a conviction if it went to trial... They were lacking in evidence... Those directly involved said he probably would not have been charged/convicted- because the main witness was no longer available (dead) to testify...


If Judges continue to throw out- or get overturned on plea agreements- pretty soon no one will accept them and the courts, detectives and prosecutors dockets will be overburdened with cases... Which means a couple of you tightwads would have to dig deeper into the moth bit wallets to give taxes to Uncle Sam for more courts and courtrooms... :wink: :roll:

We will have to see how this affects further plea bargain agreement pleas down the road and whether more either refuse to plead- or the prosecutors decide to let them walk free for lack of evidence to guarantee a conviction if it goes to trial....

Sounds lame to me. Doesn't say much for the ability or quality of lawyers in Montana. But then the OJ trial didn't say much good about the prosecution or the quality of LAPD's investigative skills.
 
Plea agreements are a crock of sh*t anyway. There have been a many innocent people plea guilty to a crime he didn't commit because he couldn't afford a good defense, then the appointed attorneys always want to plea it out.

And on the other hand some people guilty of greater crimes get away with a slap on the wrist because the judge and/or prosecutor doesn't want to go to trial...................

As far as the Judge he has admitted he was wrong in voicing his opinion from the bench- has asked the Supreme Court of Montana to decide his penalty and gave his resignation...

Only thing I said about the Judge was the facts...If that is defending someone-- I guess you and I have differing definitions of defense...
