Palin Troopergate probe goes on after suit tossed

ANCHORAGE, Alaska (AP) — An investigator hired by Alaskan lawmakers to probe abuse-of-power allegations against Gov. Sarah Palin was free to finish his work by a deadline set for a week from Friday after a state judge dismissed a lawsuit seeking to block the probe.

The investigation is looking into whether Palin, the Republican vice presidential nominee, and others pressured Public Safety Commissioner Walt Monegan to fire a state trooper who was involved in a contentious divorce from Palin's sister, and then fired Monegan when he wouldn't dismiss the trooper. Palin says Monegan was ousted over budget disagreements.

Judge Peter Michalski on Thursday threw out the lawsuit filed by five Republican state legislators who claimed the investigation had been manipulated by Palin enemies who wanted to produce a damaging report just weeks before Election Day. Their attorney, Kevin Clarkson, said the legislative body that ordered the investigation had exceeded its authority.

But Michalski agreed with defense attorney Peter Maassen, who argued that the Legislature has broad authority to investigate the governor. The mere appearance of impropriety does not mean any individual's right to fairness was violated, Michalski wrote in his decision.

"It is legitimately within the scope of the legislature's investigatory power to inquire into the circumstances surrounding the termination (of) a public officer the legislature had previously confirmed," the judge wrote.

The independent investigator, retired prosecutor Steven Branchflower, now can conclude the probe and report his findings by Oct. 10. Branchflower has not interviewed Palin's husband Todd and several top aides who have refused to appear under subpoena. It was not immediately clear whether they now would testify.

"It's free to continue," said Maassen, who represented the Legislative Council, 10 Republicans and four Democrats who authorized the investigation, and others involved in the probe.

We don't need anymore folks that think they are "above the law".....

The Alaskan Legislature- made up of a majority of her own party- thought there was enough question and doubt that they hired an investigator that they thought was quite competent.....And she agreed to ....Its only since McBusch became involved and doesn't want anything revealed that it became political...

Folks are sick and tired of partisan horseshit, and that's exactly what is going on when you have admitted Obama supporters in control of what the "results" of the "investigation" would be. They just of well got Pelosi and Reid - it's the same damn thing.

Funny how this fellow was appointed by a Republican Legislature- Republican committe- and accepted by Sister Sarah before- who agreed to fully cooperate- but now all of a sudden when she has to put up or shut up- it all of a sudden becomes a "partisan horsesh*t.... :shock: :roll:

Sounds exactly like touchs of McBusch- which is identical to the past 8 years of Bush/Cheney......

OT, do you think it would be fair for a Judge that has stated that "All the damn wetbacks need to be sent back" to preside over the immigration trial of a Mexican National? That's about what you're saying that Palin should get into.

Sounds good to me-- I agree with the feller..... :wink: :lol: Folks don't usually get to handpick who conducts the investigation- or who is the judge or the court that has jurisdiction...

This fellow they're screaming about is just the investigator...When you call your cops up- do you get to choose the Policeman/Investigator you want to answer it :???:

Gawdimmit, OT, you KNOW this is a conflict of interest. There is no flipping way that Palin could have a fair investigation/hearing when people that have a vested interest in nailing her are involved! You KNOW this, why do you keep blaming her?

You really expect oldtimer to do anything except point fingers??
Heck all he can do is point a finger he has no resource other than that.

All he wants is his 15 seconds of national fame, ask the folks at the water hole he hangs out.
90% get up and leave as soon as he gets in the door, they leave extra big tips for the wait staff for having to put up with him, course old Elmo setting down at the far end of the bar is delighted to see DICK knowing DICK will buy him a beer just to listen to what he has to say.
Of course ELMO is a little short on reality, (kinda like oldtimer) but he and elmo has a delightful conversation day in and day out :D :D :D
