When the first case is brought before SCOTUS, after Sotomayer is confirmed, what happens if a defendant brings up the legitimacy of the newly confirmed Obama nomination?
If SCOTUS is questioned on the nomination legitimacy, due to Obama's legitimacy, do they need to answer that question first, or just dismiss the case as they did in Major Cook's case?
Would the person questioning have "standing" Might there be "injury" to the defendant, if the answer is not known, under the Constitutional eligibility clause?
