Verrry Interesting- Very unconstitutional probably too- but that never stopped GW or this bunch in Congress before..... :roll: :(

Sen. Arlen Specter, a Pennsylvania Republican, and the section's other sponsors slipped it into an unrelated, must-pass bill to fund the Department of Justice. The plan: to make it politically infeasible for politicians to oppose the measure.

The tactic worked. The bill cleared the House of Representatives by voice vote, and the Senate unanimously approved it Dec. 16.

Bush signed it into Law....

Summary:

A new federal law states that when you annoy someone on the Internet, you must disclose your identity. Here's the relevant language.

"Whoever...utilizes any device or software that can be used to originate telecommunications or other types of communications that are transmitted, in whole or in part, by the Internet... without disclosing his identity and with intent to annoy, abuse, threaten, or harass any person...who receives the communications...shall be fined under title 18 or imprisoned not more than two years, or both."

The law was changed to include the internet into a law that has been on the books for years pertaining to phone/wireless conversations.

Freedom of speech does not include anonymously harassing someone, and is not a Constitutional right.

Nope 10 years ago I got 100's of "annoying" phone calls a month...Every time someone called with some little p*ss ant problem it was "annoying"... :wink:

There has already been several court rulings on the 1st Amendment position of this type law- and all have held that its unconstitutional unless the communications were threatening or profane- or done in a stalking manner....

But this thing is too broad-- whats "annoying" to you- may not be "annoying" to me....

It doesn't bother me any-- because I have never hid who I am- my website and name and picture are all posted...If I am going to annoy someone- I want them to know who is annoying them......Not hide behind a cloud of anonymity- or like some on here, multiple identities...
In fact I like some of the sites that make you put your identity in the profile--altho there is no ascertainty or way to guarantee folks are even honest doing that....

I was curious as to the how this type law has stood up historically- so did a little digging on the Montana Law- since I knew that had been challenged and partially thrown out....

The old Montana Privacy in Communication Act used to be worded like that- but got shot down in a court challenge..They then had to rewrite it and add more specifics..But it doesn't specify anonymity or not...

(a) with the purpose to terrify, intimidate, threaten, harass, annoy, or offend, communicates with a person by electronic communication and uses obscene, lewd, or profane language, suggests a lewd or lascivious act, or threatens to inflict injury or physical harm to the person or property of the person. The use of obscene, lewd, or profane language or the making of a threat or lewd or lascivious suggestions is prima facie evidence of an intent to terrify, intimidate, threaten, harass, annoy, or offend.

It was also updated and the wording was changed from phone communications to electronic communications so it covers computers, e-mail, and the internet...
