R-CALF Won't Appeal Court Ruling On Beef Imports From Canada

KANSAS CITY (Dow Jones) - The board of directors for R-CALF United Stockgrowers of America has decided not to pursue an appeal of U.S. District Judge Richard Cebull's denial of the group's request for a permanent injunction to close the U.S. border to live cattle and beef imports from Canada, according to a statement by R-CALF USA president Chuck Kiker.



The decision was made Wednesday, the statement said.



In January 2005, R-CALF USA filed litigation against the U.S. Department of Agriculture over its Final Rule that allows imports of cattle under 30 months of age and beef products from cattle younger than 30 months of age into the U.S. from Canada, a country affected by bovine spongiform encephalopathy, or mad-cow disease.



Cebull granted a preliminary injunction to R-CALF USA in March of 2005, but it was reversed in July that same year by a three-judge panel of the U.S. 9th Circuit Court of Appeals, the R-CALF statement said.



The cattlemen's group challenged the 9th Circuit's decision by requesting either a summary judgment or the opportunity to present oral arguments at the District Court level, but the request was denied. Cebull said in his decision earlier this month that his "hands were tied" and that the 9th Circuit had instructed him to "abide by this deferential standard," and "respect the agency's judgment and expertise."



Instead, the organization will focus on other issues, Kiker's statement said. For instance, the USDA has vowed to move forward with its proposed rule to allow imports of Canadian cattle that are more than 30 months of age and the beef from such cattle.



"Through due process, R-CALF plans to keep the most current science surrounding BSE mitigation measures at the forefront of the debate and make sure that the health and safety of the U.S. beef supply is not compromised," Kiker said.



"Maintaining the integrity and reputation of producing only the safest and highest quality beef in the world is R-CALF's top priority, and is the only way we will continue to grow domestic beef demand and reopen our export markets," he said. "We will continue to pursue that goal."
