Bus stop beating becomes hate crime case

The Harris County District Attorney's Office plans to prosecute the case of a white suspect accused of beating a black man at a downtown Houston bus stop last month as a hate crime, according to court records.

Prosecutors filed a motion Aug. 26 stating they believe 26-year-old Charles Allen Cannon - charged with misdemeanor assault in the beating of Yondell Johnson - committed the crime and intentionally selected the victim because of Cannon's "bias and prejudice against a group identified by race, color, national origin and ancestry," according to court documents obtained Friday by the Houston Chronicle.

State law specifies which offenses can be enhanced with hate crime allegations, according to authorities with the District Attorney's Office. For class A misdemeanors, as in this case, the maximum possible punishment - up to a year in jail - does not change with a hate crime finding. However, minimum jail time for the charge can be 180 days if the jury makes a finding of bias or prejudice. Otherwise, there is no minimum jail time for class A misdemeanor convictions.

Kristin Guiney, Cannon's attorney, declined to comment on the case.

It is unknown at this time whether three other suspects accused in the assault - Brian Kerstetter, 32, Michael Joe McLaughlin, 40, and Joseph Staggs, 48 - will also be prosecuted under the hate crime statute. Staggs and McLaughlin are scheduled to appear in court Tuesday, and Kerstetter's next court appearance is set for Sept. 21.

Cannon, McLaughlin and Staggs are in the Harris County Jail, and Kerstetter is reportedly in the City Jail. Bail for all four suspects is $50,000 each.

The incident occurred Aug. 13 at a bus stop at Travis and McKinney where Johnson, 29, was sitting shortly before midnight when the four men allegedly approached him. Johnson said one of the four men called him the N-word before the group proceeded to swing at him, eventually bringing him to the ground and kicking him in the face.

Johnson said he is glad prosecutors pursued the hate crime allegations and hopes the three other suspects will also be tried the same way. However, he still feels the punishment is not severe enough.

"A hate crime is something serious, and it could happen to anyone else," he said. "I don't think it should just be a misdemeanor charge."

Deric Muhammad, who held a news conference about Johnson's case in front of the Harris County Criminal Courthouse on Aug. 24, called the decision to prosecute the assault as a hate crime a "bittersweet" feeling.

"It is a relief, but it is disconcerting that the process was so slow," he said.

Muhammad echoed Johnson's sentiment, saying the punishment for all offenses prosecuted as hate crimes should be heftier.

"The system needs to be re-examined," he said. "Some lawmaker with a conscience should take a look at a way of writing a bill that would increase the punishment of a hate crime in the state of Texas."

Two all-white fraternities at Auburn, Delta Sigma Phi and Beta Theta Pi, have been temporarily suspended by University administration [AU] for vicious racial hatred at this year's Halloween party [SPLC]. Costumes included a hooded and robed Klansman, several white students in blackface, some wearing the shirts of a national Black fraternity, Omega Psi Phi, and one wearing blackface and a noose around his neck. Pictures included posed scenes of lynching and police brutality (all of the frat boys have big stupid grins on their faces—ha ha ha, genocide is really ******* funny, boys). I have known for a long time that the white fraternities at Auburn, and elsewhere, are some of the most reactionary networks on campus. There have been repeated problems from the fraternities for years in terms of racist, homophobic, and sexist discrimination, as well as a long record of repeated sexual violence against women. But this—this took me by surprise. And it disgusts me that anyone would feel like Auburn is a community that tolerates this ****.

There is quite simply no way for a politically correct society to grasp these events, much less effectively deal with them. Liberals have reached the depths of self-deception and self-censorship in response. The Washington Post, New York Times, and the Chicago Tribune, have all openly stated that they will refuse to report on the racial facts of these violent crimes. The Los Angeles Times explains that they don't want to "unfairly stigmatize racial groups." They prefer the soft bigotry of low expectations instead.

These flash mobs have turned the comfortable narrative of racism on its head. Politicians, the media, academics, and the legal community do not have the capacity to face the issue. The reigning dogma of white racism is too deeply entrenched. There is a small grievance industry built around condemning white racism and intolerance, real or imagined. Indeed, the welfare state itself is in large part based on the assumption that whites need to give more to achieve racial equality, as reflected in President Obama's lament that the civil rights movement didn't focus on economic redistribution.

What Is the Center for Consumer Freedom, and Why Is It Attacking PETA?


The Center for Consumer Freedom is a nonprofit corporation run by lobbyist Richard Berman through his Washington, D.C.-based for-profit public relations company, Berman & Co. The Center for Consumer Freedom, formerly known as the Guest Choice Network, was set up by Berman with a $600,000 "donation" from tobacco company Philip Morris.

Berman arranges for large sums of corporate money to find its way into nonprofit societies of which he is the executive director. He then hires his own company as a consultant to these nonprofit groups. Of the millions of dollars "donated" by Philip Morris between the years 1995 and 1998, 49 percent to 79 percent went directly to Berman or Berman & Co.

Richard Berman is an influence peddler. He has worked out a scheme to funnel charitable donations from wealthy corporations into his own pocket. In exchange, he provides a flurry of disinformation, flawed studies, op-ed pieces, letters to the editor, and trade-industry articles, as well as access to his high-level government contacts, who are servants of the industries he represents.

Berman's name might sound familiar. In 1995, Berman and Norm Brinker, his former boss at Steak and Ale Restaurants, were identified as the special-interest lobbyists who donated the $25,000 that disgraced then-House Speaker Newt Gingrich, who was hauled before the House Ethics Committee for influence-peddling over the money. Berman and Brinker were lobbying against raising the minimum wage.

Richard Berman is a spin doctor. For example, he has argued against a Mothers Against Drunk Driving (MADD) initiative to lower the blood alcohol content (BAC) limit for drivers by claiming that the stricter limits would punish responsible social drinkers. He has claimed that U.S. Centers for Disease Control and Prevention (CDC) warnings about salmonella-related food poisoning are just "whipping up fear over food."

Here's how an internal Philip Morris memo described Berman's spin: "His proposed solution would broaden the focus of the 'smoking issue,' and expand into the bigger picture of over-regulation." Smoking won't kill you; over-regulation will.

Berman is "a one-man wrecking crew on important issues." His approach has been described as "misleading" and "despicable." Berman has been called "a tobacco company whore," but he's branched out since then.

Using "freedom of choice" as his battle cry, Berman has now taken on PETA and a number of other groups and organizations whose points of view could have an impact on the profits of his clients by waking consumers up. Berman's Guest Choice Network has an "advisory panel" whose members in 1998 included officials representing companies ranging from Cargill Processed Meat Products and Outback Steakhouse to Minnesota Licensed Beverage Association and Sutter Home Winery. Berman's clients are companies with vested interests in low employee wages; cheap, unhealthy restaurant-chain food, particularly meat; and tobacco, soft drink, and alcohol consumption—companies like Ruth's Chris Steakhouse, Armour Swift, and Philip Morris, whose product line includes Kraft Foods and everything from Marlboro cigarettes to Oscar Meyer wieners and which is a major shareholder in its former subsidiary Miller Brewing, now known as SABMiller.

PETA's recent successes in gaining fast-food industry concessions for more humane conditions for farm animals have sent ripples of fear through the food and beverage service industry. About the same time that McDonald's buckled to PETA's demands, Richard Berman changed his front group's name and stepped up his attacks.

The key to Berman's aggressive strategy is, in his own words, "to shoot the messenger ... we've got to attack their credibility as spokespersons,"—an interesting remark from someone whose background and funding so severely challenge his own credibility.

The epidemiology of Transmissible mink encephalopathy (TME) indicates an alimentary origin. Several inter-species transmission experiments have not succeeded in establishing with certainty any natural reservoir of this prion strain, although both ovine and bovine sources have been suspected. Cattle exposed to TME develop a spongiform encephalopathy that is distinct from classical Bovine Spongiform Encephalopathy (c-BSE).

Inoculation of c-BSE to cynomolgus macaque provided early evidence of a possible risk to humans, and remains an important model to define the risk of both primary (oral transmission from cattle to primate) and secondary (intravenous intra-species transmission) exposures. We have also evaluated the transmissibility of other cattle prion strains to macaques, including L- and H- atypical forms of BSE, namely BSE-L and BSE-H, and cattle-adapted TME.

BSE-L induced a neurological disease distinct from c-BSE. Peripheral exposures demonstrate the transmissibility of BSE-L by oral, intravenous, and intra-cerebral routes, with incubation periods similar to c-BSE. Cattle-adapted TME also induced a rapid disease in cynomolgus macaque. The clinical features, lesion profile, and biochemical signature of the induced disease was similar to the features observed in animals exposed to BSE-L, suggesting a link between the two prion strains. Secondary transmissions to a common host (transgenic mouse overexpressing bovine PrP) of cattle-TME and BSE-L before or after passage in primates induced diseases with similar incubation periods: like the c-BSE strain, these cattle strains maintained their distinctive features regardless of the donor species and passages.

If the link between TME and BSE-L is confirmed, our results would suggest that BSE-L in North America may have existed for decades, and highlight a possible preferential transmission of animal prion strains to primates after passage in cattle.

Background. Classical, or C-type, bovine spongiform encephalopathy (BSE) has been extensively described in the literature. Recently, two novel forms of BSE, termed atypical BSE, have been reported in a number of countries. These new forms show differences in the biochemical characteristics of the prion protein and, where reported, tend to occur in aged animals but descriptions of clinical presentation are incomplete or absent.

Materials and Methods. Female Hereford/Angus cross calves were intracranially challenged at approximately five months of age with 1 ml of a 10% brain homogenate originating from Canadian field cases of BSE which had been previously classified as C-, L-, or H- type.

The animals were monitored during incubation period, and clinical disease is described using a standardized examination protocol. Incubation period, description and progression of clinical signs was recorded and videotaped for objective evaluation.

Results. All L- and H- type atypical BSE challenged animals began to display signs of clinical disease at approximately 11 months post inoculation, and disease progression was slow but constant until animals were euthanized. Clinical signs in all atypical BSE inoculated animals included hesitation at doors and gates, spontaneous muscle fasciculations and sensitivity to touch. Teeth grinding and excessive salivation are occasionally noted. Animals with L-type BSE are very anxious and show high levels of sensitivity to hand movement. One H-type animal shows periods of somnolence. Both H-type inoculated animals go down during handling and have difficulty rising and show sensitivity to movement around their head and neck area, but to a lesser degree than the L-type BSE inoculated animals. Interestingly, no locomotor abnormalities have been observed in either group.

C-type challenged animals remain normal at approximately 18 months post inoculation. Clinical disease in C-type inoculated animals from a previous transmission study was typically slow and intermittently displayed during the initial stages and after a period of two to four months was more consistent and progressive. Clinical signs in C-type BSE were as previously reported in the literature.

Discussion. The spectrum of clinical signs for all three types of BSE examined is similar. Incubation period is shorter for H- and L-type BSE as compared with C-type. Once clinical signs begin, progression is slow but relentless in atypical BSE, and more insidious in classical BSE. A summary of clinical signs presented in the three different types of BSE will be presented, and video of clinical disease will be displayed.

Atypical BSE in Cattle

To date the OIE/WAHO assumes that the human and animal health standards set out in the BSE chapter for classical BSE (C-Type) applies to all forms of BSE which include the H-type and L-type atypical forms. This assumption is scientifically not completely justified and accumulating evidence suggests that this may in fact not be the case. Molecular characterization and the spatial distribution pattern of histopathologic lesions and immunohistochemistry (IHC) signals are used to identify and characterize atypical BSE. Both the L-type and H-type atypical cases display significant differences in the conformation and spatial accumulation of the disease associated prion protein (PrPSc) in brains of afflicted cattle. Transmission studies in bovine transgenic and wild type mouse models support that the atypical BSE types might be unique strains because they have different incubation times and lesion profiles when compared to C-type BSE.

When L-type BSE was inoculated into ovine transgenic mice and Syrian hamster the resulting molecular fingerprint had changed, either in the first or a subsequent passage, from L-type into C-type BSE. In addition, non-human primates are specifically susceptible for atypical BSE as demonstrated by an approximately 50% shortened incubation time for L-type BSE as compared to C-type. Considering the current scientific information available, it cannot be assumed that these different BSE types pose the same human health risks as C-type BSE or that these risks are mitigated by the same protective measures.

Seven main threats for the future linked to prions

First threat

The TSE road map defining the evolution of European policy for protection against prion diseases is based on a certain numbers of hypotheses some of which may turn out to be erroneous. In particular, a form of BSE (called atypical Bovine Spongiform Encephalopathy), recently identified by systematic testing in aged cattle without clinical signs, may be the origin of classical BSE and thus potentially constitute a reservoir, which may be impossible to eradicate if a sporadic origin is confirmed.

***Also, a link is suspected between atypical BSE and some apparently sporadic cases of Creutzfeldt-Jakob disease in humans. These atypical BSE cases constitute an unforeseen first threat that could sharply modify the European approach to prion diseases.

2.65 At its hearing on 14 May 2010, the committee heard evidence from Dr Alan Fahey who has recently submitted a thesis on the clinical neuropsychiatric, epidemiological and diagnostic features of Creutzfeldt-Jakob disease.48 Dr Fahey told the committee of his concerns regarding the lengthy incubation period for transmissible spongiform encephalopathies, the inadequacy of current tests and the limited nature of our current understanding of this group of diseases.49

2.66 Dr Fahey also told the committee that in the last two years a link has been established between forms of atypical CJD and atypical BSE. Dr Fahey said that: They now believe that those atypical BSEs overseas are in fact causing sporadic Creutzfeldt-Jakob disease. They were not sure if it was due to mad sheep disease or a different form. If you look in the textbooks it looks like this is just arising by itself. But in my research I have a summary of a document which states that there has never been any proof that sporadic Creutzfeldt-Jakob disease has arisen de novo-has arisen of itself. There is no proof of that. The recent research is that in fact it is due to atypical forms of mad cow disease which have been found across Europe, have been found in America and have been found in Asia. These atypical forms of mad cow disease typically have even longer incubation periods than the classical mad cow disease.50

Based on the results obtained with in vitro conversion assays, the opinion concludes that there is probably no absolute molecular barrier to transmission of TSE agents between mammalian species. Results also suggest that these assays may be developed as a tool for quantifying the transmission barriers between species for different TSE agent strains; however, there is no means at the moment to transpose in vitro results into the likelihood of in vivo interspecies transmission.

Background:

An update on atypical BSE and other TSE in North America. Please remember, the typical U.K. c-BSE, the atypical l-BSE (BASE), and h-BSE have all been documented in North America, along with the typical scrapie's, and atypical Nor-98 Scrapie, and to date, 2 different strains of CWD, and also TME. All these TSE in different species have been rendered and fed to food producing animals for humans and animals in North America (TSE in cats and dogs ?), and that the trading of these TSEs via animals and products via the USA and Canada has been immense over the years, decades.

Methods:

Results:

I propose that the current diagnostic criteria for human TSEs only enhances and helps the spreading of human TSE from the continued belief of the UKBSEnvCJD only theory in 2009. With all the science to date refuting it, to continue to validate this old myth, will only spread this TSE agent through a multitude of potential routes and sources i.e. consumption, medical i.e., surgical, blood, dental, endoscopy, optical, nutritional supplements, cosmetics etc.

Conclusion:

I would like to submit a review of past CJD surveillance in the USA, and the urgent need to make all human TSE in the USA a reportable disease, in every state, of every age group, and to make this mandatory immediately without further delay. The ramifications of not doing so will only allow this agent to spread further in the medical, dental, surgical arena's. Restricting the reporting of CJD and or any human TSE is NOT scientific. Iatrogenic CJD knows NO age group, TSE knows no boundaries. I propose as with Aguzzi, Asante, Collinge, Caughey, Deslys, Dormont, Gibbs, Gajdusek, Ironside, Manuelidis, Marsh, et al and many more, that the world of TSE Transmissible Spongiform Encephalopathy is far from an exact science, but there is enough proven science to date that this myth should be put to rest once and for all, and that we move forward with a new classification for human and animal TSE that would properly identify the infected species, the source species, and then the route.

We agree that the transmission of CWD prions to beef livestock would be a troubling development and assessing that risk is important. In our article, we cite a peer-reviewed publication reporting confirmed cases of laboratory transmission based on stringent criteria. The less stringent criteria for transmission described in the abstract you refer to lead to the discrepancy between your numbers and ours and thus the interpretation of the transmission rate. We stand by our assessment of the literature--namely that the transmission rate of CWD to bovines appears relatively low, but we recognize that even a low transmission rate could have important implications for public health and we thank you for bringing attention to this matter.

CWD to cattle figures CORRECTION

I believe the statement and quote below is incorrect ;

"CWD has been transmitted to cattle after intracerebral inoculation, although the infection rate was low (4 of 13 animals [Hamir et al. 2001]). This finding raised concerns that CWD prions might be transmitted to cattle grazing in contaminated pastures."

Within 26 months post inoculation, 12 inoculated animals had lost weight, revealed abnormal clinical signs, and were euthanatized. Laboratory tests revealed the presence of a unique pattern of the disease agent in tissues of these animals. These findings demonstrate that when CWD is directly inoculated into the brain of cattle, 86% of inoculated cattle develop clinical signs of the disease.

Little things like spelling simple words, not to be confused with typo errors, are very telling in his vocabulary and about his education, or lack of.

About 90% of the people who respond to his garbage on other internet communications think he's an idiot also and he doesn't even realize it. :roll:

Personally, I think he's had too many of those supplements that he thinks killed his mother.
