Here is an interesting situation- where both cults chosen champions agree that the mandate constitutes a penalty- and not a tax...




Romney breaks with GOP, says mandate is a penalty, not a tax

Mitt Romney's presidential campaign broke with congressional Republicans on Monday by arguing that the individual mandate upheld by the Supreme Court last week is a penalty, not a tax.

The majority in the court's decision ruled it constitutional because it was a tax, and Republicans in Congress since that decision have hit the White House hard for raising taxes through the new law.


But a spokesman for Romney on Monday said the former Massachusetts governor agrees with Obama that the individual mandate is a penalty or a fine, rather than a tax.

Both the healthcare ruling and the conflicting statements highlight the trouble Romney has in going after the president on healthcare. As governor of Massachusetts, Romney instituted a healthcare law that includes an individual mandate, and at the time, he too portrayed it as a penalty or a fine, rather than a tax.

In fact, Fehrnstrom pointed out in his interview that Romney "has consistently described the mandate in Massachusetts as a penalty."
 
Since it's been ruled that a penalty is unconstitutional and Maobama says that it is not a penaldy, when will he scrap the law and start over with a LEGAL bill?
 
Oldtimer you do realize that if John Roberts had agreed with Obama and now Romney on the mandate of your hero's signature bill being a fine and not a tax, the bill would have been ruled UNCONSTITUTIONAL. :? :roll:

By Roberts claiming it was a tax and upholding the mandate he just told the US Government they can make a person in the US do what ever they demand an if not the Federal Government has the right to TAX them into compliance. NO fining of non compliance just TAX THEM UNTIL THEY AGREE. That is just disgusting for a so called Conservative Judge to do something that stupid. But with all the brow beating the Democrats did on the Supreme Court I'm not surprised that one of the Conservative Judges didn't crumble under their rhedoric :roll:

BTW both saying it is not a tax doesn't really have the same reasoning. Obama claims it isn't a tax because he said he wasn't going to raise the taxes on the Middle Class and the SCOTUS made him a LIAR by claim it was.

Romney claims it was not a tax but a PENALTY makes the Bill UNCONSTITUTIONAL.

I realize that but we can only hope that someday he will stop guzzling the booze spiked koolaid and sobber up to reality that Obama is out to destroy the US one friggin lie at a time. :roll:

That said I hope Boehner and Cantor hold their REPEAL Obamacare vote in the House and send it on to the Senate. As now those Democrats that are up for re-election and vote to support the bill, can't deny that they will be raising taxes on everyone. The court has ruled it to be a LEGAL TAX not an unconstitutional penalty so if they vote to keep the bill now then they support taxing the Middle Class and POOR to support their need for BIG GOVERNMENT INTRUSION into everyones lives. NO MORE DENYING THE FACTS, Democrats could care less about who has to pay as long as they can CONTROL every aspect of your life, they are HAPPY AS PIGS IN A SWAMP. :x

it may be difficult to get a majority of support and garner more support by just voting to overturn obamacare...

it would come down party lines for the most part and give the liberals a talking point...

BUT, if they only vote to repeal the mandate TAX before the election and show how it will effect the poor,.. then they may have a better chance of not only getting it passed in the senate by pealing off a few moderate desperate democrats , then forcing Obama to veto it..

at that point, not only would the democrats own the tax.. but so would Obama
