Sex Offender Chooses Canada Over Jail

Jail or Canada? Malcolm Watson chose Canada.

In an unusual sentence that has immigration lawyers questioning its legality, the U.S. citizen has agreed to stay out of the United States for the next three years as punishment for having sex with a 15-year-old female student.

The exile starts Monday for the 35-year-old former Buffalo Seminary teacher, who was arrested in April after a mall security guard noticed him and the girl sitting in a parked car for two hours.

Erie County District Attorney Frank Clark called the plea deal "a little dicey" but said the girl's family was happy with it.

Under the sentence for sexual abuse imposed by Cheektowaga Town Court, Watson can enter the United States only to report to his probation officer. Watson already lives across the border in Fort Erie, Ontario, with his Canadian wife and three children.

But exiling a citizen is unheard of, said Robert Kolken, a Buffalo immigration lawyer.

"I don't see how a judge sitting in a criminal court in the U.S. can lawfully banish a citizen as a condition of sentencing," he said.

Cheektowaga Justice Thomas Kolbert could not be reached for comment.

Another immigration lawyer, Robert Berger, warned that Watson could be barred from entering Canada because of his new criminal record.

Even Watson's lawyer, Oscar Smukler, said he was surprised by the deal.

"We did some research on the question of whether Canada might consider throwing (Watson) out, which would make him a man without a country," Smukler said.

The alternative sentence? As much as a year behind bars.

Hey I like that idea- I can think of quite a few that I would love to give Canada...Save on jail space and still get them out of our hair...

I'm not sure that 3 years exile in Canada is much of a sentence for a 35 year old married man having sex with a Juvenile tho- 20 years in the state pen sounds more fitting....

Didn't realize conditions in Ontario/Canada were so bad that this judge thinks its comparable to prison :wink: :lol:

makes me wonder if one of the board members that lives in bc was deported from the us for the same sort of thing !
you know the one! the one that has a fasination for woman on woman porn!! posted in" someone should kick his a$$"

Lots of Americans on here never have anything decent to say about our Country<Canada> either.
Nonothing no more represents Canada anymore than Haymaker does America. Or you or me for that matter

I just heard on the radio that Malcolm Watson was arrested at the border when he tried to enter Canada. It looks like we are going to send him back :D
Thank God somebody is starting to use some common sense!
OT your going to have to think of a plan "B".

not once did i infer that no no represtented canada! only his/her/it's views which have no merit, nor did i say mention anything bad about canada other that no no lives there
go back and read what i wrote!! then respond!

Here I was hoping Canada could become the US's Australia... :wink: :lol:

You have went to a new low. Why is it ok to imply such a thing about another board member?????? What value does your post add??? Seems to me someone is more about personal slams then debate and topic review. :roll:

Mrs Greg I hope you aren't going to send all those hollywood stars back to our country. The ones that said if GW was reelected, they'd move to Canada. We can do without movie stars just fine.
