With Judge Sonia Sotomayor already facing questions over her 60 percent reversal rate, the Supreme Court could dump another problem into her lap next month if, as many legal analysts predict, the court overturns one of her rulings upholding a race-based employment decision.

Three of the five majority opinions written by Judge Sotomayor for the 2nd Circuit Court of Appeals and reviewed by the Supreme Court were reversed, providing a potent line of attack raised by opponents Tuesday after President Obama announced he will nominate the 54-year-old Hispanic woman to the high court.

"Her high reversal rate alone should be enough for us to pause and take a good look at her record. Frankly, it is the Senates duty to do so," said Wendy Wright, president of Concerned Women for America.

Three were overturned?

This is hardly a compelling argument without more facts. With just this few cases, you would think you could give specifics on each of the 5 cases to make your argument. There might be something there worth watching. The Supreme Court could be wrong 3 out of 5 times themselves, it depends on the facts.

They were wrong from the end of the Civil War until the 60s when they finally recognizing the civil rights of people in this nation regardless of color or race. Before that they were wrong from the beginning of the nation to the Civil War in not protecting the people of the United States from slavery and ownership of people.

Although the Supreme Court is the last say on our laws, they have been wrong many, many times and many many years that the law did not protect citizens.

Yes, but it does show that the Supreme Court is not absolutely correct in what they do.

When I look back, the church (catholic) wasn't right to torture in the inquisition either. They were as wrong then as they are looking back. Just because you are the last legal say does not mean that you are correct all the time. It was the abuses of monarchs, the last say of the day, that gave birth to our country.


How many cases did Sotomayor write that did not get reversed by the Supreme Court? The Supreme Court only picks up issues they want to weigh in on, not every one with merit. If they did every one with merit, they would have picked up the London case, the Pickett case, and many others.

This is an empty statistic.

There might be something there, but this statistic is not a compelling argument.

So Sotomayor has had how many decisions that the Supreme Court obviously did not have a bone to pick with and so did not pick up? Are you saying it was only 5 decisions total? Obviously the other x many were not overturned by the Supreme Court although they could have.

I think the number of decisions she has written for the majority is around 228. If only 3 were overturned then she had a 98.7% grade. The reversal rate is the inverse of this number or around 1.3%.

Mike, I would really like for you to do better here. Are you used to curving down grades when you don't like someone? Come up with real reasons, not this, as it isn't one.

From the way I understand it, 3 out of a total of 5 cases that were appealed to the Supreme Court from her court were overturned.

Plus, she is clearly a reverse racist. That's enough for me. End of story.

Whose to say whether Supreme Court decisions are right or wrong? Yes, legal scholars are often critical of the way those rulings were arrived at, but otherwise it's just our opinion. As an example, I feel the Court was dead wrong on Roe v. Wade but right on the money on Bush v. Gore. No doubt millions of Americans disagree with me on both counts. And remember, few of their decisions are unanimous, which means even they disagree with their own decisions. Sort of. :wink:

I said Scotus was wrong "according to HIM" back then, but were right "according to ME", which only makes a difference of opinions between us. :roll:

The Constitution CANNOT evolve or morph into different meanings at different times and that is exactly what Sotomayor is saying she would do while making policy on the bench.

SCOTUS must be blind in making decisions, giving equal protection under the law, with total disregard to social changes because citizens will come to believe that law is not just.

Your analogy to voting is moot and rediculous......... Congress changed the voting law and SCOTUS upheld that Congress had the right to change it. SCOTUS DID NOT, I repeat, DID NOT make that law, they only affirmed that our lawmakers had the right to change it.

It's not the Constitution that evolves, it's the LAWS as written by Congress that change as time goes on.

Yes, VanC, you are right. It really matters WHO is on the Supreme Court as to if they are right or not and your own view. That is the reason the picks are so important.

Can the Supreme Court be wrong? Yes, they are all the time. They have the last say but they can still be wrong.

Mike made his case with the assumption that they are never wrong and that only cases picked up by the Supreme Court count for whether or not a judge has a reversal rate, not the total cases that they can pick up, which is all of them. The statistic he used was not compelling as far as the argument he was making unless you believed the Supreme Court was always right and that only the cases they pick up (they have the right of picking up any case) count for some "success" statistic. Both are wrong.

There may be reasons not to have Sotomajor on the bench, but this is just a stupid argument. I wanted to know why Mike said the cases themselves warranted his criticism, not some empty statistic.

That is not the reversal rate. Someone failed math class. Her reversal rate is 3 out of 268 opinions written if that is how many she wrote, not 3 out of 5.

Read it again Tex....it doesn't say everything she heard or had any part of....jsut the five majority opinions written by her for the 2nd Circuit Court of Appeals and reviewed by the supreme court.

The Supreme Court has the responsibility of "grading" all the court decisions under them. Obviously they found only 3 cases out of Soto's 268 that SHE wrote that they had a problem with and we don't even get to know what they are because I guess some people like to quote statistics instead of real issues.

This is an empty statistic that does nothing but promote a ""lynching" without facts. Kind of funny analogy for a court.
