New law lets South Dakota schools arm teachers, volunteers

Posted: Mar 8, 2013 2:20 PM by CNN

(CNN) - School boards in South Dakota can let school employees, hired security personnel or volunteers carry guns in schools under a law signed Friday by Gov. Dennis Daugaard.

Under such "school sentinal" programs, school boards can arm such people "to secure or enhance the deterrence of physical threat and defense of the school, its students, its staff, and members of the public on the school premises against violent attack."

All school sentinels would first be required to complete a training program. Some other states, including Utah, allow teachers to have loaded weapons inside classrooms.

At my EMT recertification March 1-3, the last class was taught by a long time Rapid City police officer and EMT. As an acting police officer, he was very pleased that this law passed and felt strongly that this is a damn good law.

Actually, a representative from RC (Craig) was the main sponsor of the bill and Liberty Belle was a strong proponent and backer.

Anybody who thinks that what this law does is hand out guns to teachers as they walk into school is ignorant of what the law says and accomplishes.

Yeah Frisco-- I agree with what I've seen so far of the law- makes packing optional (I know teachers that would accidentally shoot their toe off if they touched a gun- fantastic teachers- but not someone you want packing a gun which is why I opposed anything mandatory), and requires training and qualification....

I see no conflict with the Federal gun free school zone law as long as these folks are being certified under a state law..

The Gun Free School Zones Act of 1990 (18 U.S.C. § 922(q)) states:

(A) It shall be unlawful for any individual knowingly to possess a firearm that has moved in or that otherwise affects interstate or foreign commerce at a place that the individual knows, or has reasonable cause to believe, is a school zone.

(B) Subparagraph (A) does not apply to the possession of a firearm

(i) on private property not part of school grounds;

(ii) if the individual possessing the firearm is licensed to do so by the State in which the school zone is located or a political subdivision of the State, and the law of the State or political subdivision requires that, before an individual obtains such a license, the law enforcement authorities of the State or political subdivision verify that the individual is qualified under law to receive the license;

(iii) that is— (I) not loaded; and (II) in a locked container, or a locked firearms rack that is on a motor vehicle;

(iv) by an individual for use in a program approved by a school in the school zone;

(v) by an individual in accordance with a contract entered into between a school in the school zone and the individual or an employer of the individual;

(vi) by a law enforcement officer acting in his or her official capacity; or

(vii) that is unloaded and is possessed by an individual while traversing school premises for the purpose of gaining access to public or private lands open to hunting, if the entry on school premises is authorized by school authorities.

I don't know what you guy's problem is, she was just trying to follow the law. It says you cannot conceal a gun ON your person without a CCP.

And, at least there wasn't a boobie trap! :lol:

The thing that is never said is that the leftwingers to say just call the cops.

The cops are not obligated to come protect us, so who is left to protect us

you are on your own... both against the criminal and the law....

if you get attacked,.. expect to not only have to fight off the attacker,.. but also the liberal prosecutor..

just thank GOD we have states that still have some common sense and that even our liberal states are not as bad as Europe ...

The sad part is that the generations before us fought for this country. And right now we are willing to fight for our country today but we have some who don't even have a clue what made this country so great. They even disrespect the military today as they did in the Viet Nam era, just a few different tactics. Not to mention the disrespect for the Constution they show.
