The Government's Plane Scare Was A Felony

The decision to secretly authorize Air Force One and a fighter jet to perform a low-level fly-by that sent New Yorkers and office workers in Jersey City fleeing for their lives may be a felony under New Jersey law.

After circling above the Hudson River, the planes made a terrifying turn toward the tower that houses offices of Goldman Sachs, according to eyewitnesses. Office workers in New Jersey's Jersey City literally sprinted away from windows, fearing the plane would ram their building.

New Jersey law makes "terroristic threats" a felony. In the circumstances described above, the plane's flight may be a third-degree felony.

"A person is guilty of a crime of the third degree if he threatens to kill another with the purpose to put him in imminent fear of death under circumstances reasonably causing the victim to believe the immediacy of the threat and the likelihood that it will be carried out."

Courts use three material elements when evaluating a terroristic threats charge in New Jersey: (1) the accused made a threat; (2) the threat was to commit an offense of violence; and (3) the threat was made with the purpose of terrorizing or acted with reckless disregard of the risk that third parties would react in this manner.

The key here is that there doesn't actually have to be a specific intent to terrorize. Just a reckless disregard that others would be terrorized. We have no doubt that a jury could easily find that the plane's flight plan amounted to reckless disregard that office workers would perceive a terrorist threat of death.

Just imagine what would happen to any private citizen who carried out this kind of fly-by. This isn't just a matter of finding out who should be fired for today's insane debacle. The question is who should be prosecuted.

I saw a video of this - the people in NYC had to be terrified. What a stupid stunt.

How much did it cost and what was the purpose? I can think of a lot better things to do with my tax dollars. And where are the libs on the environmental damage done by this incident? Why is it okay to burn all of this jet fuel for an Obama photo op?

OH but the "Prez" said he found out about it at the same time we all found out about it......Now what President would not know where his airplane was at any given time?? It does not move without him knowing about it. And why "photo-opts"?? Has this brillant cabinet of tax evaders never heard of "photoshop"??? They could have set a 747 on the point of a needle with photoshop for $139.00 (plus tax).

In a memo obtained by CBS 2 HD the Federal Aviation Administration's James Johnston said the agency was aware of "the possibility of public concern regarding DOD (Department of Defense) aircraft flying at low altitudes" in an around New York City. But they demanded total secrecy from the NYPD, the Secret Service, the FBI and even the mayor's office and threatened federal sanctions if the secret got out.

The NYPD was so upset about the demand for secrecy that Police Commissioner Ray Kelly vowed never to follow such a directive again and he accused the feds of inciting fears of a 9/11 replay.

"Did it show any insensitivity to the psychic wounds New York City has after 9/11? Absolutely. No questions about it. It was quite insensitive."

The cost of the frivolous flight was about $60,000 an hour and that was just for Air Force One. That doesn't include the cost of the two F-16s that came along.

What about the cost to commercial airlines. Either they had to change their flight or be put in a holding pattern.

At over $300,000.00 for the photo opt, it took more than 30 middle class Americans working all year long and paying their income taxes just for that one photo opt for Obama to massage his ego.

In what world can a president justify 30 Americans having to work a Year of their life for his one day photo opt??????????? :mad:
