(CBS/AP) Officials at an Arizona school suspended a 13-year-old boy for sketching what looked like a gun, saying the action posed a threat to his classmates.

"My son is a very good boy [who] doesn't get into trouble," the boy's mother, Paula Mosteller, told CBS affiliate KPHO correspondent Mary Valenzuela. "There was nothing on the paper that would signify that it was a threat of any form."

"He was just basically doodling and not thinking a lot about it."

The Chandler Unified School District declined to give more details about the incident. Spokesperson Terry Locke said in a statement, "Federal privacy law forbids the school or district from discussing student discipline."

There's nothing in a portion of the student handbook that addresses conduct to indicate the drawing of a weapon poses threat, KPHO reported.

There is, however, a rule that says students should not engage in "threatening an educational institution by interference with or disruption of the school."

The drawing, which is covered with smiley faces, did not show blood, bullets, injuries or target any human, the parents said. The East Valley Tribune reported that the boy said he did not intend for the picture to be a threat.

"We're not advocates for guns," Mosteller said. "We don't have guns in our home. We don't promote the use of guns. My son was just basically doodling on a piece of paper."

The boy's father, Ben Mosteller, said when he went to the school to discuss his son's punishment, school officials mentioned the seriousness of the issue and talked about the 1999 massacre at Colorado's Columbine High School, where two teenagers shot and killed 12 students, a teacher and themselves. Mosteller said he was offended by the reference.

The boy was initially suspended for at least five days, but after his father spoke to the principal, it was reduced to three.

Its IDIOTIC-- and when you look at the sketch it even gets worse...If I hadn't known they were saying it was a gun when I looked at the sketch I'd have assumed it was a building, with sidewalks, and people walking up to it....

Good thing they didn't kick you our for doodling when I was in school--was my favorite subject :wink: .... My favorites were jet planes- shooting each other down - or brands and how I could change one into someone elses....

What a PC world we have become....With NO common sense.....

Thait is pitiful OT... I wouldn't see a gun their eother unless someone told me it was one.. Min were much more accurate :lol: :lol: I also used to love drawing jets and tanks and stuff like that when I was about that age (Probably a bit younger) but man, somethings people drew wer quit impressive..

Now, about your practicing ways how to russle cattle for other fols :wink: :shock: :lol: :lol:

We talked guns a while then told me to put them away and go to class. I put them back on the window rack (1964 Chevy half ton) and went to class.....and no, I did not lock the truck and no they did not chain the gate to the parking lot.

This was 1965, Roswell High School, Roswell New Mexico. times have changed, but assuming it is a liberal-conservative thing is absurd.

Good post Goodpasture. We did the same thing when I was in school. Its a COMMON SENSE thing IMO.

In the late seventies,, we were still allowed to have a gun in the rack of the pickup... not sure if that would be allowed today..

Most didn't even take the keys out of the ignition...

But times have changed...and I'm not completely sure why..

I blame the lack of personnel responsibility..

as for the drawing of a building... the kid is a lousy artist...he needs therapy.(and art lessons)..how else is he going to grow up and be good liberal :roll: :lol: :lol2: :? :?

whenever there is a "zero" tolerance policy someone shows exactly that much intellect,..."zero"..

all this because of a bad drawing... :roll: Did anyone ask the child what he drew?..

Actually under Federal Law (unless they changed it in the last 10 years)- you as an adult- can't even have a gun within I think its 200 feet of ANY school PROPERTY (which includes parking lots)...No matter if your packing it-have it in the truck window or under the seat- or in your house...

If our locals wanted to they could catch people driving down two paved highways if they had a gun in their vehicle-- since both are within the federal distance..Also about 30 houses fall within the distance limit of schools- and if somebody wanted to push it they could be charged for having a gun in their houses...Most that live in those houses or drive down those highways don't even know the law exists- because the S.O. and P.D. use common sense....But the law is there....

You must of had a union job after school,cause my dishwashing job I had back in highschool would of never bought me an almost brad new truck, little lone guns with ammo....

I did a little research on the law-- Known as the Gun Free Zones Act of 1990...

Bad News- Good News.... Bad news...Good News
Bad news is the distance was 1000 feet of school property....

Good news- and this is hard to believe of the US Supreme Court-- they repealed it in 1995....

Bad news-- Congress repassed it correcting the flaws in 2000...So from what I gather from this-- you can't have any firearm within 1000 feet of any school...

Good News-- the law has so many exceptions, flaws, and is so wishy washy that I can't see a prosecutor ever charging it unless you are doing some really bad things with a firearm....Maybe the reason we didn't pay much attention to it-and the US attorney told us not to worry about those folks living next to the school- another one of those "feel good laws"- that are about worthless when you put them to real use...

Good thing they have the "school program" exception- so the local boys can blast off the old civil war cannon after every score in football :wink: :lol:

Summary
In general, it shall be unlawful for any individual knowingly to possess a firearm at a place that the individual knows, or has reasonable cause to believe, is a school zone. This does not include possession of a firearm on private property that is not part of school grounds.


Exceptions
If the individual possessing the firearm is licensed to do so by the State in which the school zone is located or a political subdivision of the State, and the law of the State or political subdivision requires that, before an individual obtain such a license, the law enforcement authorities of the State or political subdivision verify that the individual is qualified under law to receive the license; which is--

not loaded; and in a locked container, or a locked firearms rack which is in a motor vehicle; by an individual for use in a program approved by a school in the school zone; by an individual in accordance with a contract entered into between a school in the school zone and the individual or an employer of the individual; by a law enforcement officer acting in his or her official capacity; or that is unloaded and is possessed by an individual while traversing school premises for the purpose of gaining access to public or private lands open to hunting, if the entry on school premises is authorized by school authorities.
It shall be unlawful for any person, knowingly or with reckless disregard for the safety of another, to discharge or attempt to discharge a firearm at a place that the person knows is a school zone. However it shall not apply to the discharge of a firearm if on private property not part of school grounds; as part of a program approved by a school in the school zone, by an individual who is participating in the program; by an individual in accordance with a contractentered into between a school in a school zone and the individual or an employer of the individual; or by a law enforcement officer acting in his/her official capacity.


Definitions
The term school zone means in, or on the grounds of, a public, parochial or private school; or within a distance of 1,000 feet from the grounds of a public, parochial or private school.

The term school means a school which provides elementary or secondary education, as determined under State law.

Penalty
Whoever violates the Act shall be fined not more than $5,000, imprisoned for not more than 5 years, or both. Notwithstanding any other provision of law, the term of imprisonment imposed under this paragraph shall not run concurrently with any other term of imprisonment imposed under any other provision of law.

This does not include possession of a firearm on private property that is not part of school grounds.

The law is enforced in New Jersey...as my home is about 150 feet from one school and about five hundred feet from another,.. I can not have guns at my private property..

the rational is that I have no way to get them to and from the private property..with out breaking the law.. unless they were there prior to the law and never leave... (or a friend who is in law enforcement drops them by)... seems that the law is really just an inconvenience for the law abiding, and hopefully a tool to help Police if they catch a nut with a gun near a school..

I have to keep my rifles at another property in order to use them for hunting...

I had just hoped that not every state was as stupid in enforcing this well-meaning but misguided law...
