WASHINGTON – A top IRS official in the division that reviews nonprofit groups will invoke the Fifth Amendment and refuse to answer questions before a House committee investigating the agency’s improper screening of conservative nonprofit groups.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening – or why she didn’t reveal it to Congress, according to a letter from her defense lawyer, William W. Taylor 3rd.

Lerner was scheduled to appear before the House Oversight committee Wednesday.

“She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course,” said a letter by Taylor to committee Chairman Darrell E. Issa, R-Calif. The letter, sent Monday, was obtained Tuesday by the Los Angeles Times.

Taylor, a criminal defense attorney from the Washington firm of Zuckerman Spaeder, said that the Department of Justice has launched a criminal investigation, and that the House committee has asked Lerner to explain why she provided “false or misleading information” to the committee four times last year.

Since Lerner won’t answer questions, Taylor asked that she be excused from appearing, saying that would “have no purpose other than to embarrass or burden her.” There was no immediate word whether the committee will grant her request.

According to an inspector general’s report, Lerner found out in June 2011 that some staff in the nonprofits division in Cincinnati had used terms like “Tea Party” and “Patriots” to select some applications for additional screening of their political activities. She ordered changes.

But neither Lerner nor anyone else at the IRS told Congress, even after repeated queries from several committees, including House Oversight, about whether some groups had been singled out unfairly.

Lerner herself launched her agency's scandal with a planted question-and-answer exchange during a May 10 American Bar Association conference.
Asked the pre-arranged question, Lerner responded by conceding that her employees had acted inappropriately.
'Instead of referring to the cases as advocacy cases, they actually used case names on this list,' she told the assembled tax lawyers.
'They used names like "tea party" or "Patriots," and they selected cases simply because the applications had those names in the title.That was wrong. That was absolutely incorrect, insensitive, and inappropriate — that’s not how we go about selecting cases for further review.'
She later claimed that the increase in scrutiny of tea party groups was due to an influx of new applications from right-wing organizations, following the Supreme Court's 'Citizens United' ruling, which opened the floodgates to greater political participation by nonprofit advocacy groups.
The Washington Post called that claim bogus, however, with the newspaper's fact checker awarding it a 'four Pinocchios' rating for dishonesty.

I would hold her in contempt and let her cool her heals in jail until she decided to cooperate and testify to what she knows and who in the Obama Administration knew about this and DID NOTHING TO STOP IT. :x

They could put her in the Capitol jail for "Inherent Contempt", but she would get her day in Federal Court.

Habeus Corpus, you know.

Excused from appearing? Bull crap.

Haul her sorry, lying ass before Congress and make her take the 5th on every question for all to see. She obviously lied to Congress before and doesn't want to get her tits in a wringer this time around.

The IRS reports to the Treasury Department which reports to the Executive Branch (or as OT would say, the Administrative Branch) and Congress has oversight responsibility. I'm glad to see the "do nothing" Congress doing something. Investigate those criminal bastards!

Second they announced today the Treasury and the White House knew about what the IRS was doing and were "WORKING" out the talking points so address the issue when it broke. So the story that the Obama and Carney didn't know what was going on prior to the news reports is a bit hard to believe. :roll:

The White House was loose with the truth? I'm stunned. Say it ain't so.

What is a talking point? If you cannot admit to what you have found when you find it, then you are telling half truths and that is not the full truth.

I'd beat them upside the head with questioning about that.

Tired of hearing new terms created for old bs.

Some people need prison and some should probably hang.

Tell you where this would wind up if the digging doesn't let up---- Valirie Jarrett and David Axlerod. They knew of it, condoned it, and promised cover if it ever saw the light of day. These two knew to NEVER let the annountied one even think of even seeing someone in the IRS talk to mention, joke, or breathe a syllable of targeting.

She won't talk? Fine, play the game. Charge her with everything that you can possibly think of, arrest her, and set her ass in jail. Problem with my plan is that the charges would probably have to come via the justice department, and they carry water for Obama.

What a flipping corrupt mess that we have there - and we were promised transparancy and accountabilty.

Either House of Congress can jail her. There is precedence.

precedent for that too.

I mentioned on another forum, that the key is to bring her in, question the heck out of her and she will eventually mess up. That appears to be what happened, but they should have questioned her longer. They should have brought in Rand Paul, for one of his "torture(filibuster) sessions" :lol:
