Not sure how Michigans law reads- but I'm sure that it is much like Montana and that you have to show the intent to commit the crime was done because of the race, creed, religion, color, national origin, etc. of the victim... Which often unless the suspect admits to it- or they have made statements it was done for that reason and not just a normal rape, robbery, or theft they do each day- it is difficult to prove...

It not just a simple matter of when one race commits a crime against another... You have to prove intent...

45-5-222. Sentence enhancement -- offenses committed because of victim's race, creed, religion, color, national origin, or involvement in civil rights or human rights activities. (1) A person who has pleaded guilty or nolo contendere to or who has been found guilty of any offense, except malicious intimidation or harassment, that was committed because of the victim's race, creed, religion, color, national origin, or involvement in civil rights or human rights activities or that involved damage, destruction, or attempted destruction of a building regularly used for religious worship, in addition to the punishment provided for commission of the offense, may, if the provisions of 46-1-401 have been complied with, be sentenced to a term of imprisonment of not less than 2 years or more than 10 years, except as provided in 46-18-222.
(2) An additional sentence prescribed by subsection (1) must run consecutively to the sentence, except as provided in 46-18-222.

OK, so it must've been a "Love" crime.................. :roll:

Stabbing, shooting, and then burning.

Hate crime charges make no sense. A crime is a crime.

But we knew that when the liberals passed the laws. :roll:

I agree- calling them hate crimes is not the right wording probably...Anytime you commit a violent crime its definitely not because of love...

And I don't think they were meant to be used that often - except when you have definite extremely heinous crimes done just for race, creed, religion, color, national origin, sexual orientation reasons.... And its not that often you have that as the direct and only intent (or can prove than intent)... Usually you have drugs, robbery, or some other crime thrown in...

An example of direct intent and a good case for them to have been used in is the Klu Klux Klans killings of the little girls in the 1963 bombing of the 16th Street Baptist Church in Birmingham, Alabama. These were outright racially influenced murders and stood to have sentence enhancement if the law had existed then..
Many of the other KKK criminal acts would have fallen under it too... The KKK and some southern States inability to enforce criminal law and administer colorblind justice was the direct reason we now have the Federal Criminal Civil Rights Violation laws- and cribs full of attorneys enforcing them and these so called hate crimes ...

And maybe a "Hate" crime could have been charged when hundreds, if not thousands of Indians were massacred by the U.S. Army and civilians in Montana?

Maybe those who were never arrested and took over their land, benefitting white owners until today could have been charged with something?

One example:
The Marias Massacre (also known as the Baker Massacre or the Piegan Massacre) was a massacre of a friendly band of Piegan Blackfeet Indians on January 23, 1870 by the United States Army in Montana Territory during the Indian Wars. About 200 Indians were killed, mostly women and children, and elderly men.

Point is, there is no need for "Hate" crime sentencing enhancement laws. None. There should be no criminal laws for "Thoughts", only for the bad deeds that are against the laws of nature & people.
