The sad part of this is that the Rehberg aide that Rehberg drug along to his little drinking political party-Dustin Frost- and who is still in a coma- is by everyones accounts probably the nicest young man you could ever meet... :(

Authorities are awaiting results of blood tests from the state crime lab, and delivery of Barkus' medical records before determining whether to file charges. County Attorney Ed Corrigan has said he is weighing felony charges.

A critical piece of information will be whether or not Barkus' blood alcohol level was above the legal limit of 0.08 for a vehicle operator.

Corrigan says he hopes to get that information in the next week or so.

Driving records show that Barkus was pulled over for drunk driving a few years ago, an arrest that resulted in a conviction of reckless driving.

45-5-205. Negligent vehicular assault -- penalty. (1) A person who negligently operates a vehicle, other than a bicycle as defined in 61-8-102, while under the influence of alcohol, a dangerous drug, any other drug, or any combination of the three, as provided for in 61-8-401(1), and who causes bodily injury to another commits the offense of negligent vehicular assault.
(2) Subject to subsection (3), a person convicted of the offense of negligent vehicular assault shall be fined an amount not to exceed $1,000 or incarcerated in a county jail for a term not to exceed 1 year, or both, and shall be ordered to pay restitution as provided in 46-18-241.
(3) A person convicted of the offense of negligent vehicular assault who caused serious bodily injury to another shall be fined an amount not to exceed $10,000 or incarcerated for a term not to exceed 10 years, or both, and shall be ordered to pay restitution as provided in 46-18-241.
(4) If a term of incarceration is imposed under subsection (2) or (3), the judge may suspend the term of incarceration upon the condition of payment of any fine imposed and of restitution. If the person does not pay the fine or restitution, the term of incarceration may be imposed.

45-5-207. Criminal endangerment -- penalty. (1) A person who knowingly engages in conduct that creates a substantial risk of death or serious bodily injury to another commits the offense of criminal endangerment. This conduct includes but is not limited to knowingly placing in a tree, log, or any other wood any steel, iron, ceramic, or other substance for the purpose of damaging a saw or other wood harvesting, processing, or manufacturing equipment.
(2) A person convicted of the offense of criminal endangerment shall be fined an amount not to exceed $50,000 or imprisoned in the state prison for a term not to exceed 10 years, or both.

A Durham County Democratic Party official was charged Wednesday as an accessory in a sexual assault case that includes allegations that a couple held a man captive in a dog cage.

Diana Palmer, first vice chairwoman of the Durham County Democratic Party, was jailed Wednesday afternoon on charges of being an accessory after the fact of an assault with a deadly weapon. Investigators say she removed evidence from the home of Joy Suzanne Johnson, who had been the party’s third vice chairwoman, and her husband, Joseph Scott Craig.

Johnson, 30, stood by as Craig, 25, beat and caged a man and sexually assaulted a woman in their home. Craig, a dispatcher at Allied Waste Industries, has been charged with second-degree rape, second-degree forcible sexual offense, three counts of second-degree kidnapping and two counts of assault with a deadly weapon.

The two people he is accused of assaulting listed 2305 Albany St., the home of Craig and Johnson, as their address, according to court documents.

Johnson “instigated and encouraged” her husband as he handcuffed a man and forced him “into a dog cage, leaving him there for hours, terrorizing him.”

Johnson, a 1996 graduate of Raleigh’s Millbrook High School, met Craig several years ago, acquaintances say, through a Web site devoted to Reiki, a spiritual healing technique that traces its roots to 20th-century Japan. Craig moved to Durham from Kentucky not long after that, and some longtime acquaintances began to notice changes in Johnson. Johnson, described as bright but shy, quit her job as a researcher at Duke University. Craig usually answered the phone at their home, and she was not as open and communicative as when she first moved to Durham.

The couple married at Durham’s Eno River Unitarian Universalist Fellowship on Oct. 21, 2006.

Johnson’s bail is set at $270,000 and Craig’s at $500,000. Craig, Johnson and Palmer are partners in Indigo Dawn, a company that offers products and services “to promote enlightenment and assist in the development and self-empowerment and divine potential.”

Do you think that after working with Rehberg for over 5 years they might have been friends?
Rehberg's blood alcohol content was measured after he arrived at Kalispell Regional, and was 0.05; the legal limit is 0.08.
Drunking dinner party.....looks like he had a couple mixed drinks with dinner.

You still have yet to show me where he dragged Frost to the Dinner.

Its been 5 days with a brain injury they keep someone in a coma so they wont hurt themselves more. All reports are sayin he is improving.

LOL why wouldnt the boat insurance pay for this? It is REQUIRED in Mt.

Kalispell state Sen. Greg Barkus is in Seattle to undergo surgery on a broken pelvis at Harborview Medical Center following an Aug. 27 boat crash near Bigfork that injured him and four others, including Montana Congressman Denny Rehberg. Dustin Frost, meanwhile, the Rehberg staff member who was also severely injured in the accident, remains at Kalispell Regional Medical Center in stable condition, but "is requiring aggressive monitoring and treatment," according to a surgeon treating him.

Barkus' son, Ken Barkus, released a statement Friday saying Barkus was treated for a broken pelvis and broken ribs, as well as lacerations to his head, arms and legs following the crash. He also received several transfusions due to blood loss. Barkus, 62, spent five days in the Intensive Care Unit and was released Wednesday, then flown to Seattle Thursday for pelvis surgery.

Frost's family released a statement on his condition Friday, saying the 27-year-old Sunburst native "continues to make progress each and every day."

Neurosurgeon Robert Hollis called Frost's condition "serious."

“Dustin Frost has suffered a severe closed head injury and is requiring aggressive monitoring and treatment," Hollis said in the statement. "He is showing slow improvements in his status but still requires intensive nursing care. Further recovery is anticipated.”

Rehberg Returning to D.C. by Train After Boating Accident

Rep. Denny Rehberg (R-Mont.) said Friday that his injuries from a recent boating accident won’t keep him from returning to Washington, D.C., on Tuesday.

Rehberg broke his ankle and sustained fractures around his eye after a boat that he was on crashed into the rocky shore of Montana’s Flathead Lake on the night of Aug. 27. He said Friday that he is unable to fly but that he and his wife plan to take Amtrak to Washington from his hometown of Billings, a trek that takes two days.

“My doctor recommended that I not fly for a while so Jan and I are going to take the Empire Builder back to Washington.
I'll be at my desk in D.C. on Tuesday morning,” Rehberg said in a statement.

Rehberg was one of five people aboard the 22-foot motorboat being driven by state Senate Majority Whip Greg Barkus (R) when it crashed. Others in the accident included Barkus’ wife, Kathy, and two Rehberg aides: Deputy Chief of Staff Kristin Smith and State Director Dustin Frost, who sustained a serious brain injury and has been unconscious since the crash.

Reports say Barkus was driving the boat 40 miles per hour when it crashed and had been drinking alcohol. The Flathead County Attorney’s office has subpoenaed Barkus’ blood alcohol test results from the hospital and is weighing felony charges.
