Out of curiosity. I emailed a professor of Constitutional Law here at the U. of Illinois last fall asking the very same question. His first statement was that we are in unchartered waters. He went on to say that, in his opinion, Obama would be removed from office (he didn't say who would have the power to do that) and Biden would become president. He also said (his opinion again) that Obama would be considered the legitimate president until he was removed. Therefore, all laws signed or vetoed, all treaties entered into, etc. up to that point would stand. He compared the situation to a person being presumed innocent until proven guilty. That is, Obama would be presumed eligible until proven ineligible, therefore everything he did up until the point he was removed would stand.
Bottom line: I don't think anyone knows for sure. As that professor said, we are in unchartered waters. I suppose the Supreme Court would have the final say. But you're right, Ben, it would be a heckuva mess.
