[Madison, WI] As tens of thousands of public employees skipped work this week to attend protest rallies outside the Wisconsin State Capitol, many wondered if they would face any disciplinary action for unexcused absences.

On Saturday, a group of men and women in lab coats purporting to be doctors were handing out medical excuse notes, without examining the 'patients.'

“I asked this doctor what he was doing and he told me they were handing out excuses to people who were feeling sick due to emotional, mental or financial distress,” said Christian Hartsock. “They never performed an exam–he asked me how I was feeling today and I said I’m from California and I’m not used to the cold, so he handed me a note.”

Based on an examination of the signature and medical license number provided, one of the men handing out these notes was purporting to be James H Shropshire MD, a Clinical Associate Professor at the University Wisconsin Madison.

So is it legal to fake doctor sick notes? The answer may depend on where you live in and your state laws. You also need to consider sick pay and other terms of employment. If you are getting sick pay, some lawyers may argue that it is a criminal deception.

what is the punishment for fraud/criminal deception?

loss of job..

loss of license ??..

local laws or RICO?

I would also suggest that it is possibly in violation of their contract, if so, is it any wonder that bargaining rights are being re-examined?

Unions are claiming the reporters are lieing about the fake Doctors slips.

How stupid are these people all the government investigators have to do is look at the document and see if it was the family doctor that signed the sick note or if all the "SICK" slips have the same doctor's name

A couple thousand notes from the same doctor dated the same day from the time frame of the public protest is a bit more than I think any Attorney General is going to overlook.

An organizer working in and for an open society is in an ideological dilemma to begin with, he does not have a fixed truth -- truth to him is relative and changing; everything to him is relative and changing.... To the extent that he is free from the shackles of dogma, he can respond to the realities of the widely different situations...."

The way I see it, Walker should be able to cut the budget a bit further. All he has to do is request the sick slips and anyone that hands one of the fake slips in is FIRED Not due to fraud but because they are to stupid to be trusted in a classroom teaching young children.

The doctors in question are Lou Sanner, Anne Eglash, Hannah Keevil, James Shropshire and Patrick McKenna.

should they really be able to keep their licenses?

No they should not be able as they knowingly broke the law by signing a document that's only propose was to defraud the WI. Government.

They have proven to everyone by their actions that they do not respect the law and the government that is to enforce them. At the very least their Licences that gave them the ability to sign the fake sick notes should be suspended and at the most they should go to jail so they have some time to think about what the laws mean to everyone INCLUDING GREEDY UNION MEMBERS. .

AND the federal government should investigate them to make sure they are not signing documents ment to defraud the Medicare and Medicaid systems. As if they are willing to defraud WI odds are they would think nothing of padding their pockets on the tax payers dime.

Wonder what these teachers would do to a student if they found out the kid skipped school, when down to the mall and bought themself a paper that the teacher had assigned them for homework. And handed it in claiming they wrote it while they were sick at home? I also wonder what the Principle of the school would say when the teacher escorts the student down to his/her office to report the cheating and the kid says well yes sir I did cheat but didn't I see you getting a fake doctors slip down on the corner that other day when you called in sick and closed the whole school down?

I would love to be a fly on the wall when the tax paying parents that are paying for teachers to closed down school by calling in sick so they could attend a protest about their pay, are called into the school and are confronted with their child's cheating. Especially if those parents saw their kids teacher acoss the parking lot while they were there supporting the Governor.

Wheres Ronald Reagan when you need him. I have talked to numerous teachers and they all said with the salaries that these teachers get they ought to shut up and go back to school. If they are a true teacher interested in the kids they would. Yet they want the kids to protest for them all the while the kids will be paying the bill for these teachers self centered selfish WANTS

These WI. teachers that publicly took fake doctors slips to cover their illegal striking have lost all moral authority with their students. The only thing their students learned from them this week was how to break the law and cheat in attempts to not have to face the consequences of their actions. When it was recorded and broadcasted to the world that they were at the protest and claiming their so called sickness that got them out of attending classes was THEY WERE SICK OF WALKER, they lost they ability to punish their students when the students claim they are SICK OF DOING HOMEWORK. And I fear that what they taught the students with their actions this week is going to effect their relationships with all authorities including their parents. Teachers that are responsible for the education of young minds should be held to the highest of standards so the students don't learn garbage like this from them.

The teachers have lost the moral high road and if there are a few that stood above the lying you will never hear about them from the media.

The doctors have lost the moral high road and if there are a few that stood above the lying you will never hear about them from the media.

Will the new fad be doctor and teacher jokes instead of the lawyer joke.

Do you want a doctor who is a liar treating you or your kids
Do you want a teacher who is a liar teaching your kids

I would not like to find out my doctor was lieing to the government about who is sick and who is not. With the amount of fraud they claim is in Medicare and Medicaid I would hope these doctors would be the first one to be check out as they can't be trusted to tell the truth anymore.

And a teacher caught lieing in such a public way that is a disgrace they can't hold anyone accountable after their little stunts. Fire them all and start over with people that can be trusted. :x

MADISON (WKOW) -- UW Health says its investigating doctors who passed out medical notes to teachers protesting over the weekend.

It is investigating whether physicians violated medical ethics or University of Wisconsin and UW health policies and work rules.

The Madison School District said teachers wouldn't get paid without a doctor's note. The District says it is aware doctors passed out a large number of medical forms.

It is still trying to figure out what to do about the notes. For now, they are collecting names of doctors involved.

One doctor we saw at the protest works with UW Hospital and Clinics and is a residency program director. No one from UW Health would speak on camera, but their voicemail says, "Anyone passing out such materials was acting on their own accord and does not represent UW Health. We will thoroughly investigate these allegations and take appropriate action."

They also said in a statement, "These charges are very serious... The investigation will identify which UW Health physicians were involved and whether their behavior constituted violations of medical ethics or University of Wisconsin and UW Health policies and work rules."

A UW Health spokesperson released the following statement, "These charges are very serious and in response the University of Wisconsin School of Medicine and Public Health and the University of Wisconsin Medical Foundation, two of the entities that comprise UW Health, will immediately launch an investigation of the reported behavior."

"The investigation will identify which UW Health physicians were involved and whether their behavior constituted violations of medical ethics or University of Wisconsin and UW Health policies and work rules. The investigation and any potential future action will follow the established procedures of the University of Wisconsin. Any future disciplinary action taken will be considered a personnel matter, and in accord with University of Wisconsin policies, will not be open to public discussion."

The Wisconsin Medical Society says they do not condone the physician's actions under any circumstances.
