WASHINGTON, June 3 /PRNewswire-USNewswire/ -- For the fourth time this year, implementation of an executive order requiring that all federal contractors use the E-Verify system to check worker's eligibility has been postponed. With no rule in place, federal contractors will be accessing billions of dollars of stimulus money while having the freedom to hire illegal aliens and displace U.S. workers.




The delay provides further evidence of the Obama administration's unwillingness to enforce U.S. immigration laws and its intent to abandon even minimal protections for American workers struggling to find jobs as the economic crisis drags on. The move belies administration promises to get tough on employers who knowingly hire illegal aliens at the expense of American workers and taxpayers.



This latest delay means that 15 months will have passed from the time former President Bush signed the executive order. During that period conditions for American workers have steadily worsened. Unemployment has risen from 5.5% in May 2008 to a 25-year high of 8.9% in April 2009, while millions more Americans are involuntarily working part-time. A total of 5.7 million U.S. jobs have disappeared since December 2007. At the same time, The Department of Homeland Security (DHS) reports that over 112,000 employers are now using E-Verify, with 2,000 signing up for the program each week.



"Despite the need for E-Verify to protect American workers and the enormous success of the program, the administration and the Democratic congressional leadership are stubbornly ignoring a proven resource that helps prevent illegal aliens from displacing American workers," stated Dan Stein, president of the Federation for American Immigration Reform (FAIR). "States understand the value of E-Verify in protecting jobs. Twelve states have made E-Verify mandatory in some capacity, yet the Obama administration refuses to extend those same protections at the federal level."



Delaying the E-Verify regulation for federal contractors demonstrates only too clearly the Obama administration's attempt to have it both ways when it comes to immigration enforcement. Appearing multiple times before Congress this year, Homeland Security Secretary Janet Napolitano has professed support for E-Verify. Yet, when it comes to implementing a regulation that has been designed to require contractors who are paid with taxpayer money to use E-Verify, the Obama administration has nothing to show except delays.


"The same administration that rushed through the most massive spending bill in history before anyone had a chance to read it claims to need months of delay to review regulations for a program that state and local governments are already using successfully," noted Stein. "Given the magnitude of the employment crisis, and given this administration's record of swift action, the executive order requiring that federal contractors use E-Verify should have gone into effect months ago," Stein continued. "The fact that we are facing yet another delay demonstrates that gaining amnesty for people who broke our immigration laws remains a higher priority for President Obama than the plight of millions of unemployed Americans."

Its not only Obama or Democrats fighting E-Verify-- but many Repubs, sold out to Big Business, and the Chamber of Commerce have crawled into bed with the ACLU and filed suit to stop it....

Is it possible that the new Administration also sees this Federal "MANDATE" as unconstitutional too.. :???: Definitely raises some Federal Authority and States Rights questions...

Not much different than the battle against NAIS- Federal "Mandatory" ID that the majority of cattle producers oppose having made mandatory...Or the "Real ID" many states have voted against....

Personally I think use of it should be voluntary- BUT if caught hiring an illegal invader without having used it- the full extent of the authority of the law be brought down on the business hiring them- with maximum penalties...

E-Verify works so well that it's already been credited with a miracle: bringing Republicans and Democrats together

Republicans in their party's corporate wing support businesses that want unfettered access to cheap labor. Democrats in their party's recruitment wing see a future bright with the votes of Mexican families crossing the border illegally to find jobs and eventually becoming clients of government programs.

But because E-Verify works, politicians figure there's no real rush to actually use the darn thing. If it didn't work, they'd demand its implementation, like almost every other government program.

The U.S. Chamber of Commerce opposes a federal mandate for E-Verify. It says its opposition is based on constitutional grounds, not because of Immigration. But these things intersect, and in December, the chamber filed a federal lawsuit to stop Bush's executive order.

"We have some businesses who use it voluntarily, and others who find it to be a pain in the butt," said Randy Johnson, vice president of the Washington-based chamber. "We support the extension of E-Verify as a voluntary pilot program."

Many Repubs sold out as well? How many? They have no shame if they'd crawl in bed with the ACLU. I think that illegals working for stimulus dollars is a big slap in the face to the citizens of our country. But let's not forget....the Repubs ain't in charge.

Most Repubs in the House voted for e-verify- as a vote for it, was also a vote against the stimulus bill...

The Chamber is the ones that have crawled in bed with the ACLU and sued to stop it....
The only Repub not to vote for it in the Senate was Johanns...

It appears as tho it is the Chamber of Commerces/ACLU's lawsuit which is holding up the implementation.....


E-Verify Rule Postponed Until September 8, 2009

The federal government has told a Maryland judge that it plans to delay for the fourth time the effective date of a rule requiring certain federal contractors and subcontractors to use the E-Verify program. The rule – which would amend the Federal Acquisition Regulation (FAR) to mandate that specified contractors use the electronic employee verification system for current and prospective hires – was initially issued on November 14, 2008, and was to take effect January 15, 2009. Due in part to a lawsuit challenging the legality of the rule, the implementation date was pushed to February 20, then again to May 21 and June 30. The government has requested a stay of the litigation so that the new administration can review the authority of the rule. Pursuant to this request, the government said it would move the start date of the rule until September 8, 2009. A formal announcement of this delay is expected to be published in the Federal Register.

A bill introduced by Rep. Gabrielle Giffords (D-AZ) would extend the E-Verify program through September 2014. The Employee Verification Amendment Act of 2009 (H.R. 2679) would also order a General Accounting Office (GAO) study to determine the cause of errors made by this employment verification system, and its effects on small businesses.

E-Verify is an Internet-based system that allows employers to determine the employment eligibility of current or potential employees and to verify their social security numbers and other identifiers by providing a link to federal databases. Operated by the U.S. Citizenship and Immigration Services (USCIS) in conjunction with the Social Security Administration (SSA), E-Verify is currently a voluntary program. A rule requiring certain federal contractors and subcontractors to use E-Verify was recently delayed for the fourth time until September 8, 2009.

The Employee Verification Amendment Act would also extend the EB-5 Regional Center Pilot and the Special Immigrant Nonminister Religious Worker Programs, as well as the waiver of the foreign country residence requirement for certain international medical graduates through September 30, 2014.

This bill has been referred to the House Committees on the Judiciary, Education and Labor, and Ways and Means.

As I understand it now, there is only a paltry 300 and some dollar fine for hiring an illegal, if caught. If E-verify does happen to be implemented/required by September, will there be a larger penalty for not using it or hiring an illegal?

The US Chamber of Commerce is of course pushing the elimination of the e-verify law. This has been on Lou Dobbs numerous times. The Chamber's influence on our Congress is unbelievable. Time for me to e-mail my congressman again!

All 3 of mine voted for E-Verify- 1 Repub- and 2 Dem Senators....

And I agree- the fine for first offense should be about $1000 an illegal- with double that amount and jail for any subsequent offenses- and they wouldn't have to be "mandating" anything....

President Bush amended Executive Order 12989 to require most federal contractors to check the eligibility of new hires and certain existing employees to work in the United States by using the E-Verify system, an electronic database jointly administered by the Department of Homeland Security and the Social Security Administration.

Federal regulations implementing this requirement were originally scheduled to go into effect on January 30, 2009, but the Bush Administration postponed that effective date by a month after the U.S. Chamber of Commerce filed a lawsuit challenging the validity of the E-Verify requirement. After President Obama took office, his Administration twice postponed the effective date of the regulations implementing the revised Executive Order 12989 to give the Administration an opportunity to consider the E-Verify requirement.

So why did Bush postpone it in the first place :???: Was he in bed with the Chamber and Big Business :???: Or did he also know it is a badly written rule- and didn't want to get a bad Court opinion overrulling it... :???:

It would stand a much better test in court- if it was a legislated law requiring federal contractors to use it- then it would by just being an Administrative "rule"...

Well looking at Otimer's post it appears at least a part of the reason is the litigation by the Chamber and ACLU. But I have no doubt that Obama as well as McCain, and Bush were/are for amnesty. I am not.

Maybe he didn't think he'd get the heat he got from Big Business- and that the National Chamber of Commerce and American Civil Liberties Union would crawl into bed with each other and sue to stop it....

It would be much better to go into court with a Congressional legislated "law" than an administrative executive ordered "mandate" which could end up getting you a bad ruling that sets "precedent" against the entire E-Verify program...

This makes no sense. E-Verify is only a Gov't program to help employers screen applicants so that they will not be guilty of breaking "Immigration Laws", i.e. hiring illegals.

No need for Legislation. It's a simple way to keep people from breaking a Law. In other words...........it's only for Law Enforcement purposes. :roll:

But- the Bush order mandates it in order to do business with the Federal government---and Americans hate "mandates"...Especially ones that are made by administrative order or bureaucratic rule- and not by law...

Like I said- I'd rather see it remain voluntary- with strict enforcement and stiff penalties if caught employing an illegal that wasn't checked thru E-Verify....

Sounds to me like the Chamber would like for their folks to be able to keep breaking the law and hiring semislave illegal labor.....

In fact, there are several states that require it as mandatory.
