It actually seems rather simple to me.
Any aerial hunting conducted in SD. must comply not only with the Airborne Hunting Act but also with all laws, rules and regulations enacted by the state.
LB..."Any aerial hunting done without the permission of the landowner and without an aerial hunting permit IS a violation of the federal airborne hunting act. Period."
Oh OK. Then he DID violate federal law. At least we are now clear on that.
Liberty, come on now! Considering the above and...
OK, I assumed that hunting without permission was a violation of the Federal Airborn Hunting Act. Perhaps not.
Liberty, you overlooked my question. Does the GF&P allow other predator districts in the state to hire their own pilots which then hunt on their own, without the guidance, control or...
OK thanks Liberty.
I really dont have a dog in this hunt but do find the debate interesting. As I stated in an earler post I think it helps in a discussion to listen to others instead of just defending my own position.
You say the GFP pilots are treated differently, How? Are they not required...
Thanks SJ, I see your point. But I dont think its a valid one.
I dont know this JJ fellow but from what I've read here, wasnt he convicted of violating some federal laws? Also as I understand it he does not work under the "control" or "guidance" of a game dept. employee, correct?
If thats the...
But in reading SH's posts, I was under the impression that as a state trapper he too has to have signed permission slips for anyone he works on or flys.
Aren't the state trappers required to have permission slips for the land "their" private pilots hunt, the same as this JJ fellow you use?
I...
Liberty Bell,
I should stay out of this, but I'm not sure why you are so concerned with verifying that a trapper has his permission slips signed?
As a landowner you KNOW if the trapper has permission to be on YOUR land. Surely your neighbors all know the same regarding their ranch.
Isnt that...
Katrina,
I'm not SH nor am I in law enforcement. But I did stay at a Holiday Inn Express last nite!
"Are game wardens like law inforcement?"
Yes for the most part. They go to the same DCI school as other officers. I have been told that CO's can't make felony arrest but not sure if thats...
Interesting discussion.
Actually I believe patrolmen can and do stop vehicles without any probable cause. One example would be sobriety checks. Another would be safty inspections on trucks. Obviously drunk driving and truck safety would be seen by most as more important than making sure one has...
