Bad Wreck and a question

A story to tell, followed by a question:

On the Second of August my sister-in-law Laurie, my brother Jim, my niece Jessica and I were gathering cows off of Vega State Park near Collbran, CO. The park had asked us to do this even though the cows weren't ours. Laurie's horse was stung by ground bees (we later found welts from about 45-50 stings) and ran off with her. The horse ran onto some pavement leading to a campground in the park and while kicking at his belly caused Laurie to fall off of him. He fell down two strides later and rolled completely underneath another horse. He was later found to have a few cuts and bruises and major road rash and is on his way to a complete recovery.
Laurie on the other hand was badly injured. She had a split vertebra in her neck, which luckily did not paralyze her. She has two broken arms, and had to have surgery in her right forearm to put in two plates and fourteen screws. Sadly those were the least of her injuries. When she hit the pavement her head struck as well. This caused bleeding between her brain and her skull. This pressure caused her to lose control of basic functions and memory. Luckily after two weeks in Intensive Care, and another few days in a regular room in the hospital she was released to come home. The doctors said that being home would help her recover faster. She is recovering a lot faster, and is supposed to get one of the two casts pulled off of her arms.

My question is this: Does anybody know of a way for me to try and get the family ranch some help? With the hundreds of thousands of dollars in medical bills, the farm's already been foreclosed on, and we're about to lose the house and everything else. Any advice would be greatly appreciated.
 
I am probably the last person in the world that anyone would expect to hear this from, but......consult an attorney!!! Also, start getting together with neighbors/friends/relatives to put together fund-raisers for this family!!! Spaghetti dinners, silent auctions, bake sales, raffle tickets, chili cook-offs and such will go a looooong way to helping with the bills!! Also, many hospitals will work with you toward paying your bills.....you just simply have to talk to the right person!!! If you even WHISPER the word "bankruptcy" they have a tendency to say "now, wait...let's work something out!!" I with this family the very best of luck and if there is anything more I can do to help, you have only to say so!!!

I listen to David Ramsey. He is a financial guru and can help avoid bankruptcy. He is a wonderful person, not like a lot of radio talk show hosts.
You can call him, his number is on his website, I believe and
I think you can email him on his website too. He may have a great idea for you. He certainly in knowledgeable and wise and best of all, CARING.

Whatever you do, do not leave one stone unturned. If I hear of something else beneficial, I will certainly pass it on.

I feel deeply for the family and the individual. We had a similar situation in 1988 when our son-in-law was kicked in the head by a horse. He sustained a stem injury that he has never fully recovered from.

A bankruptcy attorney is a GREAT idea!! They know the in's and out's of all the laws dealing with such topics.
 
I would certainly agree with consulting an attorney but I think I'd take the opposite approach. Instead of being defensive I think I'd go on the offensive. Didn't the state park officials request your help and you helped them? The accident happned on state property and you were working for the state directly or indirectly. I believe I would give the state an opportunity to help pay the bills. I am not a big fan of the "sue happy" society we live in but in this case I think I would sure give it a shot. I'd look for a sharp attorney with a reputation for this kind of lawsuit. It is also possible he would take the case for a share of the proceeds rather than an upfront fee. If he took the case in this manner then he would believe you had a good case that he could win. If he wouldn't take the case this way I'd go to a different attorney. In this situation it looks like a thing where nice guys finish last. You need to kick some A_ _ and take some names. Good luck.

I agree,this is not a case of someone being greedy.it is a case of just wanting what they had before they got hurt....Workmans compensation should be also looked into,if she was hurt at work,as it sounds like she was?For not only her bills to be looked after but also for training, if she can no longer continue at her job..Head injuries should not be dealt with on a legal position right away,it can take months or years for them to heal,and some times the lingering affects never go away..
 
For the record it is possible in Colorado for sure to declare only a medical bankrutpcy.

A good friend had a premie baby about 18 years ago. They declared medical bankruptcy and kept all their assets, including the business.

You probably still want to get an attorney to sue the state. God knows they waste enough of our money sounds like some needs to go here. Good Luck
 
Thanks for the advice. I'm working with my brother trying to figure out options. He's going to talk with his attorney Monday, and see what he thinks.

I've been saying since the day she was hurt that the State Park needed to be the one paying the medical bills, but I don't know if anything will ever come of that.

On the up-side; she had the casts on both arms removed, and now only has a removable splint on her right arm. This is so that she can do physical therapy on it.

I don't know if it will help, or not, but I know a fella in Pueblo who is an attorney. I can get you his number if you want to call him. I don't know that he is in that kind of specialty, but I bet he would know the basic steps and probably be able to recommend someone. For this kind of situation, you need a guy who specializes in personal injury. The guy who writes your will or does the bankruptcy probably is not well versed enough in tort to be that effective. Let me know if I can get some references for you.
