BMR, the problem I have with the decisions is that the Strom's reasoning totally falsified some of the facts in the case (that evidence of price discrmination was presented) and came up with their own conclusions not based on the trial evidence. The 11th circuit actually allowed witness tampering after the fact in the London case. They then cited this case to come up with their conclusions and they changed the "or"s to "and"s which totally changes the law.
These corporate interests are ruining our country and its foundation. I am encouraged that this reality is not just my own. Yesterday I attended a church service as a visitor. I don't go to that church. It was a service between two churches, different denominations, and different races. I was very encouraged that the frauds we are seeing in this and other industries have not gone unnoticed by others that are totally unrelated to my viewpoint.
I was listening to the radio or tv and heard something that illustrated the problems we are having in this country. There was a CEO that was caught for stealing 4.5 million dollars from his company. He was sentenced to 3 years in jail, serving 1.5 and then under house arrest or parole for the other 1.5. Within the next few sentences of the broadcast there was some information on a bank robber who got 85 years in prison. The bank robber was an ex policeman who had robbed some local banks, I don't think at gunpoint. He got away with under $50,000.00 in total. Being an ex police officer he probably knew how to rob a bank with minimum risk to himself and others. He probably knew he did not even need a gun. I don't know the particulars of either story so I am assuming a lot of things here but the observation is still valid.
To give the corporate guy 3 years and the policeman 85 when the corporate guy did 4.5 million and the policeman did under 50 k is ridiculous. It should have been the other way around. These judges have something wrong with them when this type of "justice" is handed out.
We do have two different "justices". The Pickett plaintiffs found that out. As I said before, I am encouraged that this realization is becoming common knowledge. It is only with this knowledge that we can get change. That is why I have been so persistent with this board and the packer backers. Most cattlemen/farmers don't want to get into this stuff, they just want to produce what they produce and feel good about what they do. They want to make an honest living. The fact is that they have to deal with some real sharks.
