Gate problem

Its not whining How would you like someone dictating your life. Having some one watching & knowing your coming & going. Its not any of his business he did all this because people are not having this. He thought everything that he says we were all going to say ok not a problem Everything that he has said has been lies. He wants to be controlling. He had one of the guys that rents a place from the property owners arrested because he said things into the camera rancher said he felt threatened,. So he spent 5 days in jail & then rancher dropped the charges rancher Didn't want to have to go to court wonder why. Didn't want to have to explain on what he done. Don't keep reading if your sick of the whining. I just don't like somebody thinking they can do Whatever they want get away with it they can't.
You are talking to ranchers here and if someone is watching their coming and going with illegal installed cameras on another's property, such as you indicate here, that matter would be settled within minutes.

If he moved the road entry point and gated it as you say, then I would put the road entry back where it was. Leave his gate be.. Get permission from the state and install a cattle guard. If he didn't like it, then let him call the sheriff. If he has no document to show he had permission to move the entry point, then he could be arrested for trespass. By Arizona law he has to contact all that have titled easement on the road and let them know he is proposing changes.

If the road has a name and you have addresses with 911 numbers, then that is an important factor. That is why I asked about it.

You see as ranchers, most chose to take the offensive rather than be forced in defensive. Sometimes a rancher is outnumbered and out monied so they get railroaded by the lawyers and people that are getting rich by subdividing ranch land and changing a way of life that may have been in a family for generations. Most ranchers are not fans of subdivisions. It sounds as though, you aren't in a subdivision, but properties with long time titles. I think you may have more rights on the road than you think and it may not even fall under prescriptive easement anymore.

In the case of our esteemed member, Two Gullies, he is in Texas where ranches are being destroyed every day, so he sees your post as whining. I understand where he is coming from, since in your opening post, you indicated an inconvenience by having to get out and put in a code to open a gate. You also said this 💩 head made ranchers look bad. That told us you don't understand real ranchers.

This guy isn't a rancher in my way of thinking and I don't need you telling me he makes me look bad. I do a great job of making myself look bad, all by myself, thank you! 🤣

If you are driving across someone elses' land (private property) coming and going to your house, then you don't get to dictate when,where,or how you are being watched.Learn to live with it or move.

I agree with that for the most part, but I do understand under the illegal circumstances, this new to the area land owner, removed someone else's cattle guard and then moved the public access point to enter and then gated it, because he had a conflict with another neighbor, then I would put it back the way it was., leaving his gate and cameras untouched.

If I don't like something, I change it, if possible. If rattlesnakes by the gate code pad was a problem, then there would be a pile of lead poisoned rattlesnakes piled up to the side. If my aim was poor and the camera got hit, then oops e daisy, that is part of living in the west is what I would tell this bully. and the sheriff if the guy was stupid enough to call him.

However, despite my love of Colts and Winchesters and shooting rattlesnakes, I would just change the entry point back to where it was and put in a cattle guard and maintain it. Problem solved.

Good fences and cattle guards make for good neighbors. Tight barbed wire gates build character and appreciation for all these new fangled automated gates, some that can be operated with a cell phone or remote like a garage door opener. No one gets out of their vehicles, faces death by rattlesnake bite, and all have a Merry Christmas and a Happy New Year.

Maybe have a community Thanksgiving dinner and invite this guy and see what might result. My guess is there is folks in the neighborhood that like to fight. Perhaps this place is near Tombstone and doomed for a showdown at high noon. ;)

That gives me an idea. Put up a sign just off this gate a ways declaring it the OK corral. Also another sign identifying yourself as Wyatt Earp challenging anyone who chooses to go against you.

Let me tell you something else.A gate over dirt is way easier to open and close than a gate in the middle of a cattle guard. Things could be worse.

When you take him to court this will be his answer.Sure I'll put the cattle guard back in judge,but my cows,sheep,or goats are walking that guard and I need to put a gate over it to keep them from doing that.I also want to install some cameras ,because some fool that's going thru it is leaving the gate open all the time and I want to see who it is so I can remedy that situation.

Try opening and closing the gate over the cattle guard in some high heels 4 to 8 times a day.

You experienced in opening gates over cattle guards in high heels, Mr. Two Gullies? Eight times a day, in heels, seems a bit extreme. Not judging just inquiring. :sneaky: :ROFLMAO:

I hauled hay from up behind Missouri Buttes, 17 cattle guards The last two do have a pipe that can lock across them with a padlock , used this time of year for hunting season , and when needed, talked with one of the previous owners of this ranch, He said yeah, he helps his dad haul little bales from up there and there was not that many cattle guards back then but he got to open 7-8 gates each way he got to open and shut.
 
All these gate stories are bringing tears to my eyes. I mean ridged swinging hinged gate over cattle guards, were a treat, heels or no. I mean pull the latch, usually a sliding pipe, and then push off with one foot and ride the gate to its resting spot. Walk back across the cattleguard using the balls of your feet and such was easy even in my "cowboy" Spanish dancing boots with 3" heels.

Shutting the gate was just a reverse process riding the gate and stopping it in the right spot for a quick latch. Now compare to a 5 wire well staid barb wire gate, maybe 20 footer so wide equipment could pass, and the gate could also be pulled back at a 45 degree angle, attached to a seeming useless post, making a funnel for pushing cows into another pasture. All our gates swung both way. So swinging metal, wood gates, or barbed wire? When I had my own place, all my gates were hinged double swinging pole.

I think that no judge is going to hear this case, because the party filing has not suffered any loses other than inconvenience. Without a titled home and property owners agreement concerning the road, then any suits have to be filed by the property owners suffering losses. Inconvenience isn't considered a loss in ranch country. If nobody that owns land where these "crimes" were committed, wants to file charges with the DA, then no judge is going to consider it.

He cannot force anyone to shut the gate since there is no livestock present and it isn't his land. Maybe it shuts automatically. Small acreages with road easement across ranch land has always led to conflict. Biggest problem I had was these folks thinking they could let their dogs run at large.

No ma'am, but I'm well versed in doing it in boots and I'm just figuring that heels would be worse.

As to the number of times walking on the cattle guard to open and shut gates would be 2 times when you left and 2 times when you came back home (4).Another trip to the store or to pick up kids at school or something would be 4 more times on the cattle guard as you went out and came back home.
 
Us property owners never had any problems with each other, until he moved out here 2 yrs ago. Didn't have problems with him, until he started to do all this crap didn't even talked to anyone. We found out when we came upon the gate. Well its a good thing you live in Texas then.I wouldn't wish this crazy rancher on anyone

I never said I was in heels Never said I was driving on his property to get to ours because that's not the case. Only drive down the road that leads to my property And to another property and to another property. Part of the road leads to where hunters can go with their permits but he doesn't want them going up there and that is state land So tell me again he has rights to do this. Oh yeah I almost forgot and none of you guys have mentioned the 6 padlocks that are on this gate what is that all about I know what it's about it's made to look like the gate is locked so nobody will try to go through it But they can't anyway now because there's a code you have to put in. Walk over here to the keypad put it in get back in your car make sure the gate doesn't hit your car cause it only opens up 1 way In or out. yes I did lose wages when I came upon this gate with the locks because The day before it was a total different gate I even text him told him to get down there and unblock this gate so I can get to work He never responded but I know he read my text cause it said he read my text so yes he is being vindictiveness. You are getting real feedback, you just don't like it. Keep in mind we only have one side of this story (and it's a garbled, unintelligible wall-of-text at times).

Not really sure why you expected more. This isn't your farcebook neighborhood drama group, so nobody here is really interested in the drama you create in your day-to-day life.

Not to mention, your very first post set the stage for our replies to you when you lumped us all together:

No. Somebody that you claim is a rancher that I don't even know makes me look bad? No, that doesn't make me look like anything. Nor does it make the other ranchers here look like anything.

Let us know what the judge decides, because we're not the arbiter of your dispute. The fact that you continue to try to litigate it here makes it appear that you don't have much of a case.

If you took time to read other threads on this forum and interact, you would find a great group of people that enjoy having fun. Like many before you, you came on here to post about you, and only you, and hoped for support and maybe sought apologizes from ranchers for this crazy guys actions.

I am on your side that he didn't have any right to do what he did, if he did it without permission.

If he locked the gate and didn't notify you, give you a code, or a key, then that was when you should have called the sheriff. That was a crime. If that happened to me, I would have filed charges with the DA. That was the time to take a stance, not now.

As Texan said, your stories don't add up. I have tried to give you good advice based on what, sometimes evasive, info you have posted. I have tried to get across to you that much of your complaints won't mean anything in a court of law. The judge won't care how many non functional padlocks are used to make others think the gate is locked. They won't care that you have to get out and punch in a code. They don't care if rattlesnakes are in the area, they don't care he removed a cattleguard because the owner of the cattle guard doesn't care.

Yes, if you have documented evidence that he locked you in and you couldn't get to work and lost wages, then you can sue for that. As I said, that was the time to call the sheriff. You could have filed for being detained against your will. That is against the law.

You see to ranchers, most of your complaints are beyond petty. Things like calling that old rusty gate, a prison gate and an eye sore. That would be an issue if you were living in a suburban HOA, but not out in the desert where you live.

I am puzzled why you live out there.
