Gate problem

@dhannaman I am posting your photo to help me understand how the road in question is located to the gate.

Is that trail looking path going up the mountain, the road or is the road to the left and run along a fence?

Am I correct seeing the gate swings in to the left? Does it rest against the fence when open? Before this gate was there, was there just an opening in the fence? How far does the fence run either side of this gate. It looks like an old sign that request closing the gate. Did he put up everything seen in the gate photo, the poles holding it, etc.? It looks like an old gate. How long ago did he put this gate up?

Please don't call that a prison gate. That is an insult the the fine people that make secure and high quality gates for prisons. :ROFLMAO::ROFLMAO::ROFLMAO:

I was very impressed with the sign on the right hand side of the picture, reminding the cows to close the gate.

If you took time to read other threads on this forum and interact, you would find a great group of people that enjoy having fun. Like many before you, you came on here to post about you, and only you, and hoped for support and maybe sought apologizes from ranchers for this crazy guys actions.

The guy isn't a rancher in my book.

I am on your side that he didn't have any right to do what he did, if he did it without permission.

If he locked the gate and didn't notify you, give you a code, or a key, then that was when you should have called the sheriff. That was a crime. If that happened to me, I would have filed charges with the DA. That was the time to take a stance, not now.

As Texan said, your stories don't add up. I have tried to give you good advice based on what, sometimes evasive, info you have posted. I have tried to get across to you that much of your complaints won't mean anything in a court of law. The judge won't care how many non functional padlocks are used to make others think the gate is locked. They won't care that you have to get out and punch in a code. They don't care if rattlesnakes are in the area, they don't care he removed a cattleguard because the owner of the cattle guard doesn't care.

Yes, if you have documented evidence that he locked you in and you couldn't get to work and lost wages, then you can sue for that. As I said, that was the time to call the sheriff. You could have filed for being detained against your will. That is against the law.

You see to ranchers, most of your complaints are beyond petty. Things like calling that old rusty gate, a prison gate and an eye sore. That would be an issue if you were living in a suburban HOA, but not out in the desert where you live.

I am puzzled why you live out there.
It was nice and peaceful. Everyone minded their own business. Nobody went out of their way to mess with each other. Everyday coming home there is something else. He has put up rebar almost in the middle of the road. Barely can see it in the day going to work when its dark out won't be very visible. Before you say just take it out. I am not going to give him anything saying I am destroying or vandalism. He is just digging himself in deeper like I knew he would.

I couldn't have said it better. Thank you for giving me feedback & not telling me I am just complaining. I am doing what is right standing up to this guy. The other property owners had enough also. So we are all moving forward with this. Going to have an lawyer that specializes in easements and have them help us with filing the documents along with all of our information from the beginning up to now.

I know people who have gotten in lawsuits, and even though they wound up winning, would do anything to not ever be in one again. Good luck!! I hope your attorneys don't get the farm. They are usually the winners in this kind of thing. But, you gotta do, what you gotta do. Should help that others are with you. Friends won a lawsuit that lasted 4 years. Amazing what goes on that just plain isn't right in lawsuits. Name changes, money for expert testimonies, professionals flat-assed lying; lawyers turning things over to other lawyers; I had no idea what all went on in lawsuits until I was privvy to one.

I think you might find we are not the old meanies you might think we are. I find approaching situations with a sense of humor, is the best way. Sarcastic humor has kept ranches going for years.

Also since the request comes from Chief Two Gullies, that is an honor. ;)

Do rattlesnakes hide under cattle guards ? If they do I sure would not want to try and open a gate over a cattle guard.
I know guy who could hear a rattler in a cattle guard. He was walking on it looking for the snake armed with a 22. His foot slipped and went down into the cattle guard. H tore most of the skin off that leg jerking it up out of there.
