point of fact. Road is PUBLIC from 33ft each way from middle of the road. Is the landowner the ONLY one paying for road repairs? If they want to pay all the expense......culverts washed out, more gravel added etc.....Yes...i am supporting the landowner. Every time they go to the mail box and get their gov check, im supporting the landowner. Every time i fill my truck with gas in their town for road hunting, i support them. Every time i eat in their cafe, im supporting. When i buy a soda at the gas station, im supporting. HOW MUCH MORE SUPPORT WOULD YOU LIKE? I have stayed in motels, ate at their steakhouse, bought a box of shells, maybe a dozen nightcrawlers or some minnows, maybe a new lure.........i spend more money in their towns than many of themselfs do anymore.
 
NENM, you have no idea what road hunting is. You dont live in the pheasant capital of the world. You have no clue. I have never said its always the fault of the landowner, there is always a few bad apples that ruin it for everyone. However, i know of landowners that have been ticketed for shooting from the road.....and the animal was on their own land, its still illegal. I know of a VERY large operation, im talking in the 10s of thousands of acres of ag land, that have had combines, grain trucks, tractors etc confiscated because of poaching deer. Caping them out, selling the heads, hides etc for minimal while letting the animal rot. It happens, and its not always Joe Hunter that causes the problems.
 
I beleive and support the right to road hunt just as the SD Supreme Court does. When it is done the correct way it is a very safe and legal way of hunting and ethical.
Sure you have the idiot public hunters just like the idiot landowners in any situation.

The car parked in the middle of the road is no more dangerous then coming over the hill anf there are 3 combines with 40 ft headers coming right at you, or the feed wagon, or a semi that is so over weight it is dangerous.
Yes I support the ranchers all the vehicles I drive on the roads are licensed, taxed yearly, how about all the heavy Ag stuff? do you pay yearly taxes to destroy "OUR" roads.

And Denny if I am a piece of crap for road hunting, you are....you can fill in the words, you have such a good way to discuss things and such an adult about it.

A few years ago I popped over a hill and there was a Suburban 10 feet over the hill with all 4 doors open and people(some were kids) and dogs in both ditches. I hope I scared them half as bad as I scared myself when I went through the ditch sideways at 60 mph missing everything. More likely they were mad at me for being an Ahole because that is the way road hunters think.

umm. deer hunting from a road is illlegal. Period!!! I don't think anybody has ever advocated that. Pheasant road hunting is leggal in this fine state, sorry about yours. Funny thing is though, it's also legal to shoot coyote, fox, coon, any varment from the road, out the window even, but yet do you see any rancher griping about that. :o :shock: Funny huh.????

You dillusional moron, do you give a dime to the guy who ownes the sidewalk you walk on in town. Or a quater for driving on the street to get groceries???

Ponder this, A city person pays more tax per dollar than any of you fricken ranchers do or any of us farmers! And I put it that way since, :wink: ya know, ranchers and farmers aren't the same?? :shock:
 
I can think of no other way to be more "Unsportsmanlike" than to shoot any game from the road.

Let's see.....a guy (or guys) driving down the road while exerting huge amounts of energy upon a vehicle accelerator pedal sees a pheasant (or other such game) crossing under a fence.

The driver speeds up to cut the animals' ability to cross the road safely while the other guys pulls out his shotgun and shoots the animal dead before the animal knows it.

Just how sporting is that? Legal or not legal.

Down here, shooting a gun while within 200 feet of the right of way is illegal. It should be that way in all states.

It's also illegal to use a motorized vehicle as a way to harvest any game here.

I rest my case, according to road hunters I am at fault. If I had it to do over again there would be 2 less doors on that Suburban because I am lucky I didn't kill one of the guys it the ditch.

oh, yea, thats right, it's our fault that you are going way to damn fast to contorl you pickup in the 1st place. Your half right, nobody should park on the back side of the hill like that, but you should not being going so damn fast that you can't react to a slow moving tractor over that hill either! typicall rancher, nothing is ever their fault, It's always the weather, or government, another country, east river! funny huh?? Its to bad that these people from other states think road hunting is so bad, what is wrong with walking a ditch with your dog and shooting at flushing birds either over the road or the land? The problem is people spouting off about something that they have no idea about it.
But then the landowner cant make a dollar off of it or cant control it so it has to be bad no matter what it is.
 
here are the LAWS for those of you that live elsewhere and have no clue, or for those who live here and have no clue.

The vehical must be pulled over to the right as far as possible, drivers side doors must be shut and the engine turned off. You can not shoot withing 660 ft of an occupied dwelling or cattle. You can not shoot anything that originates further than 33ft from the center of the road. Example. the road right of way is 66 ft. 33 ft each way. if a rooster pheasant runs across a road, and hides in the cover of a ditch, and is flushed withing the 66ft right of way, its fair game. If the bird runs under the fence and is further than the 33ft from the center of the road, its off limits. If the bird flushes within the right of way, and flies over the fence and is further than the 33ft, its fair game since the bird originated from the right of way and the rancher does not own the air above their land.

If there are those who do not pull over as far as possible, they are breaking the law. I suggest you get it on film and prosecute. If i am legally hunting a ditch like i do often, by getting out and walking thru the cover and flushing a bird legally and some dumbass comes up and starts harrassing me, i will prosecute.

Fact...............the landowner owns the property to the center of the road. They are not obligated to keep up the road.............the state has been granted aright of way to build a road.

Fact I own the land to the center of the road.........see if you dillusional morons can understand that. The first time I hunt or drag a plow down your frickin sidewalk...........then you can complain.
 
You dont own the road. I understand you pay taxes on it, but SO DO I. Thats my point. FACT.....the road is PUBLIC 33 ft either way of the center....period! You cant do a dang thing about it! Its been fought over and fought over and........its public. Done deal, thats the whole enchalada, end of story. My taxes are used to fix your road. Now if the creek washes out the road, im betting you get on the horn and call someone to fix the dang thing right? I would think, since its your road, you should foot the bill.
 
I own to the center, but the state and who they choose can use it ...........right. I pay taxes on that land and I pay taxes to keep up the road also.
